Erm, yeah. For one it's impossible for them to ever sue or even threaten the thousands of knock-offs created, and even so, there are parody laws and so forth that should allow you to create something like it avoiding their trade marks.
Why would they care, anyway. It's not like they're going to damage Nintendo's brand with it, it'd have to become pretty damn popular for that to happen.

Oh, and for the record my FPS didn't get above 30 on the first test, and didn't get above 20 on the second test. Average framerate was probably about 15 or so.
