Spectate not working for some players. Possible cheat?

Im observing that for some players the "spectate" command won't work. No matter how easy is the name, or if you even try to use his steam ID.

Is it a signal that the player is using hack? Or is it a known bug?

Same for me, wasn't able to spectate some players on my server.

I have run into this also. Neither me or my assigned moderators were able to spectate a certain player. I spied on him a while using the raid cam and he didn't seem to be up to no good so I let it go but even through server restarts the condition remained. His name also had nothing special about it. Just a name.

Well, I just heard that a certain very popular cheating software won't allow you spectate. So, I'm baning anyone I cannot spectate.

It could lead to some injustice, but better safe than sorry.

EDIT:

Just to make it clear. I'm observing also that it's not possible too to teleport to such persons. Too strange. No spectate, no teleport? Ban hammer in my server.
