Alright! The foundation for this model is good but you should adopt more of the ap-sap's characteristics like it's scrap look and then add minor features like a hatch partly open exposing what looks to be a servo arm and bits of wire.

As a side note, the angle at which the demoman mask item is shown made me think there was some sort of phallic protrusion at the mouth.

It's ugly. There will be licensing issue and valve will not accept an item that OPENLY and EXPLICITLY reference a game.
There are already borderland promotional item in game too, so why make more?

That's not entirely true. It's unlikely that they will, perhaps; but as long as the Team Captain, whose description even references that "their lawyers said yes" and the Vita-Saw exist, you can't say they definitively won't accept an item that references another property without being a promotional item.
everyone's worrying about copyright and i'm sitting here thinking the texture and phong's going to need some work to even be considered added.

its still in blender it is still not in the source engine

the vita-saw's similarities to bioshock are so big that the item isn't included in the store and doesn't generate any revenue to avoid copyright issues... considering that this was added at the same time they added micro transactions and money in tf2 was a brand new concept with absolutely no established system on how to handle things like this, it's safe to say that they almost certainly would never add another item under these conditions again, especially since cosmetics exist only to generate revenue.. so if anything the vita-saw is a good example of why not to make copyright infringing items
