Virginia law demands that residents keep it clean, even in moments crying out for the foulest four-letter words. It’s illegal in this state to curse in public.
“Profane swearing” is a Class 4 misdemeanor punishable by a $250 fine, right up there with public intoxication. It’s a law that predates the Civil War. Yet modern-day potty-mouths still get charged under it — in small numbers, but in ways that can raise troubling questions about law enforcement.
But a state lawmaker from a county that sounds a lot like a curse word is trying hard to get rid of the law.

A conservative on most issues, Webert says his goal is to protect free speech and shrink a bloated state code by removing a law already deemed unconstitutional decades ago under Virginia Court of Appeals and U.S. Supreme Court rulings.
“When I cursed, my mother told me not to and handed me a bar of soap,” he said. “You shouldn’t get hit with a Class 4 misdemeanor.”
Fuckin' A
Is this law enforced? We have similar laws here but they are only really enforced if someone is being a public nuisance

many areas have similar laws but they're rarely enforced. around here they're sometimes tacked on as a secondary for public drunkenness but the only time I've heard of someone being convicted of only swearing in public was a plea bargain
As far as I know, old-ass Blue laws were only overturned in the late 90s. A lot of shit like that goes unenforced for decades until removed, applied only when a cop/judge really has it out for you so they can stack additional charges onto something you're already in for.

The courts have ruled the law unconstitutional, the police can charge you with it but you (in theory) can't actually be punished for it. This is just cleaning up a dead law that's still on the books.
the hero virginia needs but not the one it deserves

We have another law that makes premarital sex illegal. It's unconstitutional by Lawrence v. Texas, but is still on the books. Virginia has no explicit age of consent, but we interpret Lawrence v. Texas to apply only to adults (since the Plaintiff was an adult), so this "no premarital sex" law is the one we use to enforce the age of consent at 18. In 2013 the republican running for governor said he would keep that law on the books and this was used against him to decry him as a puritanical zealot
