I was trying to be mocking of the people who think this would damage sales.
The worldwide gaming industry pulls in around $68bn, $3.5bn in "lost sales" due to piracy seems like a hell of a lot (5%).

Well it's stolen property because it's weeks before its actual release. I think it's fair that they banned users who played before the actual date.

If a person pirates a game, it's not a "lost sale" because they wouldn't have bought the game in the first place.

I hate this reasoning with a passion. I do agree that lost sale counts are bullshit though, because they don't factor in people who pirated the game to demo it and then deleted/bought it, or people who
owned the game but lost the disc, etc

I still disagree. Surely if they went through the effort to pirate the game, then in the majority of cases they would have bought it had the conditions been better (i.e. they could afford it/the publisher wasn't an asshole, etc). The publisher doesn't actually LOSE any money when somebody pirates, but that person still has the game without paying for it, and given that software is licensed and not owned it's legally theft of service.
I really do wish that the law would acknowledge that people have reasons for piracy other than simply not wanting to pay, but we're not going to make them see otherwise with fallacious arguments and HURRDURR LET'S PIRATE TO PROTEST (nothing against you personally of course)

That said though, I think it's really stupid of Microsoft to specifically target the people who downloaded the leak, because chances are these people would have pirated it the moment it came out anyway. That's not to say that they're doing the right thing by pirating the game, but there should be literally no difference between pirating something before it's official released and after it's officially released, considering it's exactly the same game.
In-fact, this will probably only be a good thing for Microsoft, considering that there will be at least a small group of people who decide to buy the game on day one solely because of the leak. I probably wouldn't have bought Deus Ex: Human Revolution if I hadn't played the leak first, or even Just Cause 2 if I hadn't played the demo that came out early. Unless it's a particularly shitty game, there shouldn't be much danger of losing sales over this, but then that'd be entirely their fault.
Publishers need to start realizing that some people aren't going to blindly buy their games because they're part of a popular franchise or because of shitty pre-order bonuses. If a publisher is completely unwilling to at least give players a demo (which really should be the norm in this day and age), then they're probably not confident enough in the quality of their game to do so, which understandably makes consumers afraid to hand over their money.
How can you lose sales on a game that isn't even for sale?

It's actually easy as shit, and after the launch date you can play the games online without any worry of being banned because it doesn't have any disc based verification (I think). All I know is you can play pirated xbox games on live after their launch date.

I've never been banned for using my modded xbox, and I know it IS possible but if you keep it updated then it's extremely unlikely you will.
Also modifying the game ISO is a different thing all together.
I usually torrent a game before I buy it, just to get a feel for it. Since the "demo" for the game is usually a glammed up, easy part of the game that wont show potentially game-ruining glitches or errors.
For instance, Bulletstorm was a fun game for about ten hours, but it had 0 replay value, nonexistent multiplayer, and ocassionally shit controls. And they wanted 60$ for it? Fuck you. No.
But then there's Terraria. I fucking. Loved. Terraria. About 350 hours on it, and I went out and bought that fucker. Then I bought copies four of my buddies. We still play it to this day.
