I'm thinking of upgrading my iPod, what is the highest jailbreakable firmware i can get for my iPod touch 1st gen? Is it possible the non newest one?
3.1.2 is the easiest to jailbreak since it's been out for so long.

Upgrading through itunes, I don't think he has a choice but to get 3.1.3.

Apparently there are ways to jailbreak that though. I remember reading something about it. Look it up if you want to know.
There's one for 3.1.3 but it's supposed to be unstable, 3.1.2 is probably the most common one right now.

He could just download 3.1.2 and upgrade via itunes with the downloaded .ipsw

There is a jailbreak available for 3.1.3 I believe but its tethered. If your Ipod dies you have to re jailbreak it.
Does downloaded firmware from a non iTunes source work?
