How to 'threaten' an ISP without doing anything illegal?

Basically my ISP caps my internet until I do a speed test every night at around 7. I'm completely sure that they're capping it, as I've been watching my speeds and it drops from ~1.3mbps to .2mbps instantly, and as soon as I do a speed test it jumps up to over 2.0 for 10 minutes and drops down again.

I've tried calling them a few times and they claim that it's due to "scheduled downtimes" but this has been happening for over a month now and they have to inform us of any downtime a week before it happens if it's planned.

I found out that legally they must give me at least 50% of what our plan is advertised as, and we're on a 1.5mbps connection. We don't have the money to actually take any action against them, but I want to call and at least try to make them think that we do so they stop doing this. I'm not completely sure, but I think that just straight up threatening them is illegal, so I obviously don't want to cross any lines with that, but what they're doing is just bullshit.

So does anybody have any suggestions? There's one other ISP around here, and I'm going to see if it's cheaper to switch and bring that up when I call to see if we can get our current one to give us some perk to stop us from switching (they're supposedly doing really bad right now so it isn't like them losing one out of a million).

Tell them that if they don't fix it you'll leave their service. They freak out and will do almost anything to get you to stay.

You really don't need to 'threaten' anyone. Just call and complain. They'll fix it. I had the same problem. I was suppose to be getting 12.0mb\s but I was getting 5-7 Kb\s. I called they said they would look into it. Nothing happened till the 3rd time I called. Then they fixed it. Just be persistent as hell. If you call and they don't fix it with in an hour or two call back. Get more bitchy everytime. lol
