It sounds as if this bill is aimed at making sure that people aren't unwittingly allowing themselves to be subject to surveilance. If so, I don't see any issues as long as it doesn't screw with anonymous data collection like stats and such.

This could be all avoided if they allowed the Kinetic to be unplugged when disabled.

They are. The same news release mentioning the removal of the DRM mentioned the disabling of the Kinect.

I got an idea for kinect privacy. Make the Kinect 2 face the wall and cover the microphone with cotton buds.
