I understand this, but I think this is more an issue with the horrible nature of telecom companies than it is with Apple. Wi-fi assist is a fantastic feature, and a great idea, but because the telecoms have been pushing their datacap bullshit we get things like this.
If anyone should be getting sued here, it's the carriers and their anticompetitive, anti-consumer restrictions.
TBH the suit seems fair, even though the telecom companies are bullshit if your phone has a hidden feature using data (and thus charging you) even when you're on wifi how is the average consumer possibly supposed to know that? It would also help if they have data warning/caps like android does, does iOS not have that yet?

If I was downloading a large file on my phone and it switched over to mobile I could over run my plan in about 15 minutes.
