But I thought you couldn't copyright gameplay elements?...

Wouldn't it make more sense to sue over KitKat using the name Breakout (which actually is owned by Atari AFAIK) so your desperate money grab looks like an actual case? Then again this is the same Atari that made an Alone in The Dark game about 4 players making as much light as possible so maybe they're just that stupid.
