Downloading from TPB is legal.
Using the torrent might be illegal.
They have a few copies that are supposedly retail, if you download those, then yes. Otherwise, no.
All W7 downloads on TPB are illegal, because Microsoft never allowed any to be redistributed.

Microsoft has said that it is illegal to download the RC from other sources, but I think that's bull just so they can't get in trouble for you downloading a build with viruses packed into it.

you can't purchase it yet, it's not available besides for pre-purchase. the RC got closed, and i want to know if the RC is illegal to download

Unless MS provides the ISO and shows that it's really a trial, it's just a grace period for someone who bought the product.

You can essentially "purchase" it through Microsoft Developer Network.
You pay yearly and get Windows 7 RTM through MSDN.

Yeah you can get it from MS. And you can run the trial for 450 days if you do the rearm.
