That is, at least, the experience of Hardware Canucks. In mid-August a user of Hardware Canucks’ forums posted a link to Microsoft’s own download page for the Windows 8 RTM release. In response, Hardware Canucks received a DMCA takedown request via Google. A number of other hardware forums have received similar requests for hosting Windows 8 screenshots. When asked for comment by Hardware Canucks, a Microsoft spokesperson said that, “Microsoft’s anti-piracy programs target links to infringing copies of our software.” “We take reports of inaccurate DMCA notices seriously,” continued Microsoft senior spokesperson Mark Lamb. “We will investigate disputed notices upon receipt. If the sites do not contain links to infringing copies of our software, we will contact Google about reinstating the search results.”
Alternate, NPOV source
Why would the linking be the offenders? Wouldn't aiming to take down the major sources make a bit more sense as an anti-piracy tactic?
Why would the linking be the offenders? Wouldn't aiming to take down the major sources make a bit more sense as an anti-piracy tactic?
Beats me why they aren't going after the hosts, not the linkers.
This is going to far.
This seems very counter-productive.
And people would STILL get it from torrent sites. GG Microsoft, lovin' that Streisand effect eh?
Beats me why they aren't going after the hosts, not the linkers.
They're attacking sites that linked to the download page Microsoft put on their own fucking website. Someone got a bit happy with the DMCA forms or something.
This is beyond stupid.
They're attacking sites that linked to the download page Microsoft put on their own fucking website. Someone got a bit happy with the DMCA forms or something.
Yeah why doesn't microsoft just remove the download from their website I don't get it.
Yeah why doesn't microsoft just remove the download from their website I don't get it.
They should send themselves a DMCA takedown notice, for hosting the RTM. By their logic.
So instead of arresting the drug dealer, they're arresting the guy who forwarded you to the shady guy at the corner of the street?
I don't get it. The upgrade is so damn cheap, and you still pirate it?
Some people might not have a job and/or $40, though in my opinion it's not even worth pirating. Though I'm not entirely sure if it's about pirating since it was only stated that they posted links to the official download and screenshots.
"If the sites do not contain links to infringing copies of our software, we will contact Google about reinstating the search results.”
Shows they they abuse the ability to take down websites via google by just automating the process rather than actually checking the websites.
This is pretty clearly a mistake on Microsoft's part, but actually, you know, I feel that if Microsoft could implement legitimate BitTorrent downloading of their OSes and stuff it would make things a lot easier. Obviously they'd have to implement product keys and shit, but having experienced the wonders of using BitTorrent to download Linux distributions (no joke there), I feel it's something they should really look into.
You do know it's illegal to file false DMCAs, right? If Microsoft lied in this, they could be sued.
You do know it's illegal to file false DMCAs, right? If Microsoft lied in this, they could be sued.
I sure hope that those that got sent DMCA complaints decide to. Google might be in on it too if they wanted.
I am reluctant to believe this is anything but an honest mistake on Microsoft's part that they don't deserve consequences for.
And people would STILL get it from torrent sites. GG Microsoft, lovin' that Streisand effect eh?
This isn't even close to Streisand. This is one obscure hardware site.
I am reluctant to believe this is anything but an honest mistake on Microsoft's part that they don't deserve consequences for.
They should be prosecuted to the fullest extent of the law. A DMCA is filed under the penalty of perjury. Five years of jail time for liars.
They should be prosecuted to the fullest extent of the law. A DMCA is filed under the penalty of perjury. Five years of jail time for liars.
By that logic, every American citizen would be in prison considering a lot of people make honest mistakes
By that logic, every American citizen would be in prison considering a lot of people make honest mistakes
Honest mistakes don't apply when you need to sign an actual agreement that the notice is legitimate.
By that logic, every American citizen would be in prison considering a lot of people make honest mistakes
no, because John Does mistakes don't stand up in court.
IF YOU CAN'T AFFORD $40 YOU SHOULD HAVE HIGHER PRIORITIES Sorry, had to get that out of the way
What I meant by that post is someone who's younger. Not like 24 years old and can't make an extra $40.
The big question is why would anyone even want windows eight?
Forget SOPA, regular DMCA takedown abuse and automated content blocking is destroying the internet just fine.
They should be prosecuted to the fullest extent of the law. A DMCA is filed under the penalty of perjury. Five years of jail time for liars.
chill the fuck out
chill the fuck out
You don't see a problem with people abusing the DMCA? Apple is guilty of it too. And Sony.
