SAN FRANCISCO - A federal appeals court has declared California's same-sex marriage ban to be unconstitutional, paving the way for a likely U.S. Supreme Court showdown on the voter-approved law. A three-judge panel of the 9th U.S. Circuit Court of Appeals in San Francisco ruled 2-1 Tuesday that a lower court judge interpreted the U.S. Constitution correctly in 2010 when he declared the ban, known as Proposition 8, to be a violation of the civil rights of gays and lesbians. The measure, which passed with 52 per cent of the vote in 2008, outlawed same-sex unions just five months after they became legal in the state. Lawyers for Proposition 8 sponsors and for two couples who sued to overturn the ban have said they would appeal to the Supreme Court if they did not receive a favourable ruling from the 9th Circuit.
Source - Winnipeg Free Press
Let's hope the supreme court makes the right call. Fuck prop 8 and everyone who voted for it. It disgusts me not only that such a blatant violation of rights can exist, but that it can be voted for by a majority of voters.
It's called Democracy, tyranny of the majority.
The US isn't a democracy.
The US isn't a democracy.
I never said it was?
It's called Democracy, tyranny of the majority.
A very clear example of one of the biggest failings of a democratic system no doubt.
I never said it was?
Then why'd you even mention it? It doesn't apply in the US since it's not a democracy.

With more states legalizing it, they should have no reason not to hear the case.
Democracy sucks when the majority of people are idiots.
Then why'd you even mention it? It doesn't apply in the US since it's not a democracy.
Because I can post and say what ever I want. Freedom of speech, fuck yeah :v:
Charlie Chaplin final speech in The Great Dictator a world I want to live in is a world in Charlie Chaplin's vision. I find it funny that even in todays world we have such high amounts of bigotry and hatred. Good to see things turning around finally.
I always found it fucking hilarious how Chaplin was branded a Commie during the red scare.
Democracy sucks when the majority of people are idiots.
No country has been democratic since ancient Greece and even they had flaws. [editline]7th February 2012[/editline] Goverments just like to put the concept of them being democratic into the publics mind so they dont get as much shitstorm, but honestly, you can't ignore that with how politics works now, there is a serious lack of democracy.
The US isn't a democracy.
For all intents and purposes it's a representative democracy where majority rules, but the rights of the minority are protected.
I always found it fucking hilarious how Chaplin was branded a Commie during the red scare.
The man had a mindset ahead of his time. I didn't watch that many of his shows and movies, but the great dictator alone is proof that people hated him because they were simply ignorant and that people who are still living with that old red scare mindset today are ignorant as well.
For all intents and purposes it's a representative democracy where majority rules, but the rights of the minority are protected.
How does majority rule when everything (recent examples being SOPA and PIPA) nowadays is decided by Congress and Senate which individually barely reach triple digits of people?
Then why'd you even mention it? It doesn't apply in the US since it's not a democracy.
i really love it when people try to sound smart and fail absolutely miserably
For all intents and purposes it's a representative democracy where majority rules, but the rights of the minority are protected.
Democracy is when people vote directly on an issue. A Republic is when representatives of the people vote on issues, with the rights of minorities protected. Simply possessing the ability to vote does not make it a democracy.
How does majority rule when everything (recent examples being SOPA and PIPA) nowadays is decided by Congress and Senate which individually barely reach triple digits of people?
Did you miss the word representative in my post?
Did you miss the word representative in my post?
I probably did, yes. But still, it's not as much a "representative democracy" as it is just "near-authoritarism shadowed with deceit"
Democracy is when people vote directly on an issue. A Republic is when representatives of the people vote on issues, with the rights of minorities protected. Democracy requires that the voter be smart, well-informed, and capable of critical thought. All qualities lacking in the general American population.
Democracy requires that the voter be smart, well-informed, and capable of critical thought. All qualities lacking in the general American population.
And you've met a majority of Americans to form this observations, yes?

A question to all of those who rated the article "Winner", Why do you hate states' rights? And while we're on the subject - Why do you hate the troops?
It's called Democracy, tyranny of the majority.
And that's why the electoral college exists people.
