http://www.cnn.com/2015/08/03/us/dating-app-sex-offender-registry/index.html
Zach Anderson is 19 and a typical teenager. He's into computers and wants to build a career around his love for electronics. But those plans and any semblance of a normal life are for now out the window. Under court order, he can't access the Internet, go to a mall or linger near a school or playground. His parents say because he has a 15-year-old brother, he can't even live at home any longer. Why? He's been placed on the sex offender registry after a dating app hookup. It began, Zach and his family say, when he went on a racy dating app called "Hot Or Not." He was at his home in Elkhart, Indiana, when he met the girl, who lived across the state line in nearby southern Michigan. The girl told Zach she was 17, but she lied. She was only 14, and by having sex with her, Zach was committing a crime. He was arrested and convicted.
And where's the punishment for the woman? None. This is bullshit.
What the fuck Can't it get appealed?
What the fuck Can't it get appealed?
Reading the article helps:
As for Zach, he's awaiting another court hearing in which his attorney will try to mitigate his sentence. There's no telling, of course, whether that will be successful.
Its almost frightening to fornicate these days. Cant trust anybody, and you're ultimately playing a gamble each time you decide to get intimate with someone. The tables can turn against you, sexual assault, sexual assault on a minor... all of which you'll get put on the sex offender list and your entire future will be ruined. Its pretty much the justice system saying "Hey, you should go kill yourself. Nerd"
What the fuck Can't it get appealed?
Hell in addition to an appeal I'd pursue a contract law lawsuit with the owners of Hot or Not for failing to ensure everyone on there was legal and possibly a countersuit against the girl for perjury.
The judge seems quite biased.
In fact, Judge Dennis Wiley, who sentenced Zach, said he was angry that Zach had used the Internet to meet a girl. "That seems to be part of our culture now," he said, according to a transcript. "Meet, have sex, hook up, sayonara. Totally inappropriate behavior. There is no excuse for this whatsoever,"
[editline]4th August 2015[/editline]
and possibly a countersuit against the girl for perjury.
Maybe you should read the article you yourself posted? The girl admitted to lying and neither her nor her mother wants the boy put on the sex offender registry.
Both the girl's mother and the girl herself appeared in court, to say they didn't believe Zach belonged on the sex offender registry. The girl admitted lying and outside of court, she handed the Anderson family a letter. She wrote in part, "I'm sorry I didn't tell you my age. It kills me every day, knowing you are going through hell and I'm not. I want to be in trouble and not you."
Judge is just an asshole, hopefully he can appeal the case to someone more reasonable.
The judge sounds old and angry about the internet being used for dating disgusting how there is no punishment for the girl, what was he supposed to do, carbon date her before starting or something
The judge seems quite biased. [editline]4th August 2015[/editline] Maybe you should read the article you yourself posted? The girl admitted to lying and neither her nor her mother wants the boy put on the sex offender registry.
Looking up this judge's name gives a slew of this kind of shit, too. For example, another dude who got lied to on the same "Hot or Not" app. Sounds like the typical crotchety old man. KIDS THESE DAYS ARE SO MESSED UP, etc.
Maybe you should read the article you yourself posted? The girl admitted to lying and neither her nor her mother wants the boy put on the sex offender registry.
Then why didn't the judge apply a perjury charge?
More on the judge, definitely shouldn't be a judge:
Dennis Wiley, Berrien County district judge, issued a public censure after he found a woman in contempt and jailed her for 10 days over Christmas because court clerks told him she had muttered an obscenity in the clerk's office while attempting to take care of traffic tickets.
http://www.usatoday.com/story/news/nation/2014/12/07/when-judges-need-disciplining/20053455/ [editline]4th August 2015[/editline]
Then why didn't the judge apply a perjury charge?
Because she didn't lie in court; she lied outside of court which is not a crime?
Serves him right, shouldn't have touched her before marriage.
The judge seems quite biased. [editline]4th August 2015[/editline] Maybe you should read the article you yourself posted? The girl admitted to lying and neither her nor her mother wants the boy put on the sex offender registry.
That's actually very impressive, for lack of a better word. I know it doesn't change anything, but I think it's cool she's owning up to it. Unfortunately, another case of a judge stuck in the 18th century making decisions about 21st century issues has screwed someone over. Hopefully his appellate judge is more reasonable.
The judge seems quite biased.
To say the very least should overturn his ruling on terms of an biased and unfair judgement that only reflects his idealistic society.
Maybe you should read the article you yourself posted? The girl admitted to lying and neither her nor her mother wants the boy put on the sex offender registry.
What irks me is how did this case even get brought up? Was she impregnated and the state decided to pursue charges? Did the parents discover the affair, and at first filed charges but later changed their minds. But the state decided to pursue charges? Or did the parents file charges, saw through them, and in the end said "whoa, maybe that was a bit rough." Even though they sure as hell know this isn't going to be a slap on the wrist type of situation for the teenager. The state prosecutor should've just dropped the case out of substantial evidence that he isn't really at fault for the incidence. But instead, special interest and poorly placed motivation effectively destroyed someones life. Maybe its only 25 years, but by the time this kid gets off the record he'll be 44. That itself, is no way fair. And ends up being more of a burden on a system that has failed to proceed to keep up pace with society and technology. And that judge should be stripped from his duty for such a baised decision. Perhaps he is just old and confused by the younger generation in the way its handles itself. And expected this to be some sort of benchmark/example for people to stop that. His judgement is backwards, and has no place in a progressive society.
It's getting to the point where we pretty much have to ask for ID from potential sexual partners isn't it? Granted that's less of an issue once you're not in high school, but still, it's dumb that we're ruining kids lives because of typical stupid shit kids do. This guy didn't rob a fucking bank or shoot up a orphanage, he had sex with another consenting teenager who lied about their age to make that consent legal.
I hate that this is happening so much... but the more it gets publicized, the better. More people need to see this bullshit. They need to see this shit so that a lawyer can eventually convince a jury of peers that if the guy was misled into thinking the sex he was having was legal and consensual but the girl lied to do that, then the guy isn't guilty of sexual assault or rape because how could he have known if she lied about her age.
Uuuhh aren't judges supposed to be NOT biased?

They were six blocks from the the girl’s home. Meanwhile, the girl’s mother was in a panic. The Detroit News is not naming the girl or her mother because the child is a minor. Her daughter had been gone for several hours and missed her dinnertime dosage of medicine for epilepsy, the woman said. The girl, who didn’t have a phone, had told her older sister she was meeting Anderson, the mother said. The family tried to reach him through Skype but didn’t get a response. She called 911. Shortly after a sheriff’s deputy arrived, so did her daughter. And the whole saga nearly ended right there. But the deputy had spotted Anderson’s user name, “Zach Guy,” on the girl’s computer, piquing his interest, her mother said. The Berrien County’s Sheriff’s Office had been looking into a number of cases where someone named Zach was contacting underage girls. Two deputies returned to the home later that night and pressed the girl for details of what happened, her mother said. A subsequent investigation found Anderson had nothing to do with the other cases.
http://www.detroitnews.com/story/news/local/michigan/2015/08/04/teen-jail-stays-sex-offender-registry/31091073/
The girl’s mother never wanted Anderson arrested. She tearfully beseeched authorities to drop the charge, she said. She blamed her daughter for the tryst, saying she was acting out because of her epilepsy. When Anderson was sentenced, she asked the judge to be lenient, citing her daughter’s mental and physical development as factors in the incident. Under Michigan law, a person is placed on the sex offender registry for consensual teen sex if the age difference is more than four years. But the state Holmes Youthful Trainee Act allows first-time offenders to avoid the registry and have their convictions erased after serving probation. During the sentencing, Anderson’s attorney said his client was a victim of the culture, that dating websites and apps made it difficult to determine the age of the person you’re going to meet. Berrien County District Judge Dennis Wiley seized upon the same culture in doling out his punishment. “You went online, to use a fisherman’s expression, trolling for women to meet and have sex with,” he told Anderson. “That seems to be part of our culture now — meet, hook up, have sex, sayonara. Totally inappropriate behavior. There is no excuse for this whatsoever.”
The girl should under no circumstances be punished for lying about her age. It's the law that is fucked up, and she shouldn't have to pay for that either.
And where's the punishment for the woman? None. The girl is 14, lied about her age so she could get laid, which really is not a big deal in the slightest. She had no understanding of the consequences, and even if she did, you can't just punish a person for doing nothing illegal, let alone lying. If it causes another person to unwittingly commit a crime which exists solely because of bad laws, why should she be held responsible for the flawed law? Obviously the older person should be given leeway in cases like this, but there's no reason to go after the girl. This is a disgusting mentality.
She had no understanding of the consequences, and even if she did, you can't just punish a person for doing nothing illegal, let alone lying.
She can't legally consent. ANYWHERE in the United States for that matter: [t]http://i.imgur.com/T3FRlE2.png[/t]
Girl should be hit with little more than a misdemeanor or a fine. She's a kid. She did a stupid kid thing, like so many countless kids before her, and like countless kids after this will still do.
She can't legally consent. ANYWHERE in the United States for that matter: [t]http://i.imgur.com/T3FRlE2.png[/t]
In many places, that's not defined as "she broke the law" but rather "others, in letting her do that, and her partner broke the law" - though I don't know the situation in the US in particular.
Then why didn't the judge apply a perjury charge?
Because she didn't lie in court, which is exactly what perjury is.
Girl should be hit with little more than a misdemeanor or a fine. She's a kid. She did a stupid kid thing, like so many countless kids before her, and like countless kids after this will still do.
If there is ANY punishment, it should be given to the girl for lying about her age. Even though she unknowingly did it without a full idea on what she was doing. Her punishment should be community service. Slap on the wrist.
I looked into it, apparently the girl went to visit the boy and her mother got worried because she'd gone for a while without her epilepsy medicine and she couldn't reach her, so she called 911 to try to locate her: http://www.detroitnews.com/story/news/local/michigan/2015/08/04/teen-jail-stays-sex-offender-registry/31091073/
Cant blame the mother, and you can only really admire her effort in trying to stop this abomination of a justice system. If the problem isn't rectified, the blood is on the justice system if this kid decides to end it all because his own country did no justice.
Uuuhh aren't judges supposed to be NOT biased?
You are correct. They are supposed to judge someone based on the law. And to determine if that person was knowingly acting against it. They're not supposed to be sentencing someone based on their own rules and/or opinions on how society should be acting that corresponds with their way of life.
She can't legally consent. ANYWHERE in the United States for that matter: [t]http://i.imgur.com/T3FRlE2.png[/t]
I don't know where you got that picture, but I know for ILLINOIS, this is WRONG and you will get someone on the sex offender list. 17 IS consensual ONLY if the person is within 4 years of age. This does not excuse a 30 year old sleeping with a 17 year old. I would have to check the ILGA archives, but I believe there is a law in there that if both are under the age of 17, its excusable if theyre over the age of 13, and their age gap is under 3 years.
I thought you can appeal for another judge, if you feel this one is unfair.
Well these things aren't going to help prevent the sterilization of the human race. It is bad enough in places like Germany and Japan they aren't procreating enough anymore, this isn't going to help the other places either.
“You went online, to use a fisherman’s expression, trolling for women to meet and have sex with,”
He doesn't have a clue what he's talking about...
This judge is clearly biased and needs to be thrown the fuck off this case
