If he can prove that credibility of his research and gains of it suffered from being called a publicity stunt, he sure as hell can sue for the damages caused by it.
Otherwise you could easily libel anyone publicly by getting a vague look-alike and claim that you are talking about them. That's not how it works.

But nobody even knew that the guy even existed. They created the character based on a model YEARS before Canavero was becoming important in the media.

Kojima heard about this doctor long ago(this doctor IS REAL and has been making this his life work) and started researching him.
He then wrote parts of MGS V maybe based around off of his research, not stealing it but using it as inspiration, similar to using Nano-Machines, something that is real but not like what is done in MGS.
He then found ways to try and do small connections maybe as a homage for the person who inspiried this shit.
A head transplant for snake is one of the most plausible things in MGSV at this point. We already know their are 2 snakes, and V is a symbol of split paths and is NEVER ever used as a 5 when talking about MGSV. Its always said as vee. The fact the bandaged guy in the hospital sounds just like the medic in the helicopter crash at the end of GZ(which is Kiefer with very small editing) who just so happens to also voice Snake.
It would also fit perfectly with the clashing of the series. GENE vs MEME.
Is the true super soilder big boss the one with the head and memories, the MEME?
Or is him being such a perfect soldier stored in his body? His GENEs. Or Kojima got in touch with the guy and they worked on making this marketing thing.

Most of the info the doctor has is from people sending him these theories, probably. I'm sure if the guy is reasonable, this will all be resolved after a proper explanation.

People generally tend to ask their lawyer if a case is winnable first, so I wouldn't make such assumptions.
Seeing how there's very little detail known, calling this case unwinnable right off the bat is pretty ignorant.
