The court's decision in December to reinstate a ban on same-sex relationships overturned four years ago by a lower court provoked anger and shock in India and overseas. The UN high commissioner on human rights, Navi Pillay, said the decision represented a "significant step backwards for India" and violated international law. ... New legislation, which constitutional experts say is probably necessary to overturn the judgment, looks unlikely. It would be unusually bold for an administration widely seen as weak to take on such a controversial issue so close to a general election to be held by May. The opposition Bharatiya Janata party, which has roots in deeply conservative Hindu religious and cultural organisations, has supported the reinstatement of the ban and is currently leading the polls.
If the government argued that it was unconstitutional, shouldn't they review it? Isn't the government above the supreme court in some manner? Do I quite possibly have an incredibly poor understanding of how government works? Yes.

Yes.
The supreme court in our country is usually the only voice of reason because all the politicians are too busy circlejerking to their own particular votebank to actually use their brains and this was perhaps the first time that they actually let us down. I expect sooner or later they'll revert that decision, but for now they're all idiots. Also, as a wee (not meant to be particularly offensive and silly) joke, have India's designated anti-gay device: [sp]Well, most of us here had a laugh about it, anyway.[/sp]

Sounds more like it's launching homosexuals than AT homosexuals from the text on the side. Edit: And I'm gay so that's awesome.
