I love how facepunch is so keen to point out just how different physical and digital copies are when it comes to piracy but when anyone mentions resale all of a sudden they're exactly the same thing.

The problem is that piracy is almost always compared to theft whereas it is in fact counterfeiting.
Well, I guess we can forget about reselling our Steam keys.
digital retail is another method of arriving at the same conclusion government isn't (officially) allowed to limit free speech on the internet just because it's a newer medium, same should apply here
Downloading Katy Perry =/= free speech
Downloading Katy Perry =/= free speech
how did you misinterpret me that badly the internet is a modern form of communication that was not conceived in the time that the first amendment was passed, but it's still covered by it digital retail should be handled in mostly the same way physical retail is, there's no precedent for "well since this form of commerce wasn't around back then, that law doesn't apply to it"
What does the first amendment have to do with resale?
holy shit son
Downloading Katy Perry =/= free speech
The government shouldn't be able to tell the difference between the two
holy shit son
...are you going to actually back up your statement?
The government shouldn't be able to tell the difference between the two
Except it's the companies that put out said material that are filing suit? A free speech organization wouldn't sue people who read/share their information, unless you're suggesting that said organization might sue itself in an attempt to cover up a secret about themselves, which is more than a little insane And besides, free speech isn't even a part of this, it's for commercial reasons
...are you going to actually back up your statement?
I'm not saying piracy is free speech, I'm saying that legislation on commerce should be applicable to digital sale, IN THE SAME WAY that legislation on free speech is applicable to the internet it's called a 'comparison'
com·par·i·son /kəmˈparəsən/ Noun The act or instance of comparing. An analogy. Synonyms simile - similitude - collation - compare - parallel
