Holy fuck, this changes the entire political game
Damn. And the supreme court just agreed to see aa case about the ridiculous gun bans in CT. Wonder how that's going to go now. RIP either way, he served for a long time.
I'm not going to shed any tears, but he reportedly died in his sleep, which is better than some ways to go. He leaves a fairly large family behind, though, and that's always sad.
This is bad taste but I'm wondering who will replace him.
This is bad taste but I'm wondering who will replace him.
Someone from a federal district court probably.
I don't know if this is bad taste but I'm wondering who will replace him.
Well Obama gets to nominate another judge now, the republicans will however try to block in hopes of waiting out the clock, but in the meantime, the court is now liberal controlled, so they may not want to block the nomination if Obama proposed another middle leaning judge like Kennedy just to get someone on the bench because they have their own cases coming up

hate this bastard but it's always sad to see someone die, RIP

Rest in Peace, Honorable Judge Scalia
his applesauce is no longer jiggery
"Mere factual innocence is no reason not to carry out a death sentence properly reached." rip
who? (User was banned for this post ("Why reply?" - Starpluck))
"Mere factual innocence is no reason not to carry out a death sentence properly reached." rip
So much this. That a man with this kind of moral center can decide the literal fate of not just another human being but of the way an organized society conducts justice is beyond frightening. Polarized politics are for the fucking birds.
And just like that, the world is a better place
i wonder how this affects his other cases that they were writing the decisions for
I bet the GOP stalls a new appointment for as long as they can and somehow clinches the presidential election from Clinton and another conservative dude gets the position.
Someone mind giving me the run-down on this guy? Doesn't seem like a decent human being.
Obama is going to have a shit show on his hands trying to nominate someone that will get through a hostile, electoral focuses Senate.
"Mere factual innocence is no reason not to carry out a death sentence properly reached." rip
Also, anyone mind giving me clarification on this statement?
I'm glad he got to live long enough to see gay marriage legalized in all 50 states.
"Mere factual innocence is no reason not to carry out a death sentence properly reached." rip
That's not a true quote.
Someone mind giving me the run-down on this guy? Doesn't seem like a decent human being.
A rather intelligent and articulated individual using his abilities to regress society.
who?
Antonin Scalia.
A rather intelligent and articulated individual using his abilities to regress society.
And helped to hand over a presidential election to someone, who by all rules, had lost.
After what happened with Bush v. Gore, Citizens United, not to mention all the stupid shit he said about homosexuality and the ACA, all that can be said of him is good riddance. Now we can finally replace this old bastard with somebody decent. We seriously need to impose term limits on how long our justices can serve; a 79-year-old man drenched in old timey Roman Catholic Conservatism has no place in making judicial decisions on our nation's Supreme Court.
Also, anyone mind giving me clarification on this statement?
First, it's not a direct quote to my knowledge. Antonin Scalia was famous for upholding several typically-conservative social institutions and customs, like the death penalty, moral legislation (that is, laws created against things like abortion or homosexuality) and gun control. In the case of that 'quote' it's a substantive interpretation of Scalia's defense of one particular issue with the death penalty. You see, the death penalty has an incredibly rigorous (to the point of burdensome) appeal process. One way a person can be declared not-worthy of the death sentence, and either require a retrial (which almost never happens) or be declared not guilty beyond a reasonable doubt, is on the factual basis of their conviction. For instance, if DNA evidence implicating you as the perpetrator of a particularly heinous crime was shown to be 'factually incorrect' (that is, for some reason it does not truly link you to the crime) then the entire issue of your conviction has to be thrown out. Scalia was a defendant of 'fast track' or 'secure conviction' death penalties, that required a greater demonstration of one's innocence in the appeals process than minor bureaucratic or 'mere factual inaccuracies,' because while a factual inaccuracy sounds like "well it's not true that X," in a court of law it's much more complicated than that, and it even seems quite ridiculous that one element of a complex case could get the entire case thrown out, and criminal let to go free. Personally, I am sad that Antonin Scalia is dead. Although many people here think he was an ideological monster, I believe that his attention to legal formalism was something that is itself rare and special. He was right to compare the whole-sale legalization of Homosexuality on the basis of "it's fully consensual!" to bestiality and incest. That, in the end, paved the way for stronger and more meaningful legal enshrinement of the rights of all humans, rather than weak law that merely said 'give me what I want.' I further believe that his representation of what no small portion of the country believes was necessary in creating a more fair and just court, even if I myself think those beliefs may be repugnant. It will be interesting to see who takes the seat.
