An exception to the rule.
Ha, yeah right. How about you trademark THE ACTUAL NAME instead of Each Individual Word
to be fair, the banner saga is really shoving in on their share of the bejeweled-clone market
"it's only a rule when other people break it"
"Let me be clear: This unfortunate situation is an exception to the rule," he emphasized in his letter. "King does not clone games, and we do not want anyone cloning our games."
So apparently just swapping Gems out and putting Candy in their place magically doesn't make your game a clone, eh?

Are you trying to make a point? There're so fucking different it's absurd that people would try to call one a rip-off. I mean, the only similar things I see are the color and shapes of the game items being switched around, the scoring system, the combo meter, the options menus, the back button, the layout of the game items in a grid, the fact that they all fall from the top, and the background color.

I really hope you are joking

you realize king is the company getting sued right
"it's only a rule when other people break it"
If it works for America and China, it works for King, I guess.
Still, if they're defending themselves when they're in the wrong, someone should break their shields.
While its stupid, King does have a point.
The problem is more to do with a completely broken copywright system that forces companies with major names to constantly pay lawyers to litigate in order to protect their trademark.
This doesn't fully excuse King though - its clear the only reason they are doing this, is because they happen to have a lawyer department at that company, and they need those lawyers to stay busy or make some kind of money instead of soaking up dollars. So what better way to put them to use than to use them to "defend their trademark"
The reality is that while the copyright system is bullshit, them needing to try and enforce their trademark by suing anyone with any possible likeness is also bullshit and totally unnessicary. You don't see Valve for example, needing to constantly sue anyone and anything that has anything to do with steam-related-words. Because in the end it really doesn't matter all that much, and if you do happen to get sued by a REAL patent/copyright troll over this stuff then you can spend the lawyer dollars then to properly resolve it.
Besides, enforcing your trademark is something you generally are supposed to do against real copyright trolls, not people who just happen to have a similar name. I.E. someone who makes a Candy Crush clone or blatenly tried to ride off the success of that name. Because this clearly isn't going on with King (sue anyone and anything that has Saga in the name), its pretty clear to me that King are just trying to use lawyers to make as much money as possible.
In the end, the only one who really wins under this system are the lawyers. Which is why the system will never change, because the entire "industry of law" relies on this system being broken.
"I'm sorry, but at the same time I'm not sorry."
Also to be fair Candy Crush isn't really a bejeweled ripoff point by point. Bejeweled is kind of a casual point-em-up arcade game and then stops there, while Candy Crush is actually a bit more involved and has a much stronger focus on solving puzzles within the design of the game rather than just swiping to win.
Granted, the puzzles might not be that amazing or well made or anything but its still pretty different. Play bejewled for an hour then play candy crush for an hour and you'll be able to know that there are some pretty key differences between how the two are designed. Even if they look similar.

Candy Crush Saga is not the only game that King has ripped off. Basically every single one of their games are heavily inspired by other games. That's fine. But now that they're successful they're trying to stop everyone else being inspired. That's not.
