In her ruling, Lind said that because Manning worked on and had access to intelligence reports, he would have been aware of terrorist organizations’ use of the Internet. Sudden reorganization to address vulnerabilities highlighted by the leaked documents would probably be a clear sign.
If they have evidence that the documents "aided the enemy" then they have the right to charge him with that, and by the sound of it, they do have sufficient evidence to charge him so there's no reason it should be dismissed.
