I think selling patents should be abolished to begin with. I mean, if the company that created the technology and patented it dissapears, the technology should become free to use for everyone. That way, any company that creates new techniques and technologies leaves a positive staple on the industry, and companies won't start hoarding patents so much, just to choke out the market. Maybe I'm looking at this with an overly-positive view of non-economist ignorance.

No package deals with tons of patents they will never use.

I don't think they've done anything majorly innovative lately, but who really has? The market has really been stale in all areas for the most part. Companies are staying in their comfort zones and minimizing risk as much as possible.
Patenting software is like patenting ideas.

It's an interesting idea, but I don't know how well it'd work in practise (It might get rid of the small patent trolls with crappy patents, but it wouldn't get rid of the large companies with crappy patents)
