It sounds extreme, but we have those allergy warnings at establishments for exactly this reason. If the original ingredients were free of allergens and the cheaper ones were swapped without any care, that fits the definition of reckless negligence very well. Food is serious business. I'm not sure six years is appropriate though. It wasn't a malicious act; a shorter sentence and seizure of his restaurant for fair compensation would be enough. edit: in realization that he was [I]lying[/I] about peanut content, the sentence is to me completely appropriate; read posts below
What's up with the madness regarding preservatives, allergens and that stuff in europe and the US? I mean, in all of LATAM, Paraguay, Argentina, Uruguay, Brasil, I've yet to find a restaurant that lists those things in the menu and people worried about. In fact, I can bet there hasn't been a death over this. The same regarding peanuts and such.
Meanwhile companies selling underregulated supplements kill literally hundreds of people due to the same type of negligence, and get fuck all jail time because they're rich. If this person could afford a good lawyer he'd get 6 months house arrest, tops.
From what I heard on the BBC world news podcast the owner has had repeated instances of lying about being peanut free causing others to have to go to the hospital in the past and of knowingly misleading customers.

If I had a nut allergy, I wouldn't order takeaway that's just asking for trouble. But the fact that the owner deliberately lied is just sad. What would he think would happen if his customer went into anaphylactic shock because of their food???

defo responsible. had this happen to a mate of mine in my flat and he had to go to hospital because the takeaway didn't list it contained nuts.

I think one thing that's quite interesting is that he seemed to show absolutely no remorse and didn't seem to understand, or simply didn't care, that he'd done something wrong

Eating Chinese or Indian takeaway with a nut allergy is like playing Russian roulette, a good number of them don't list their ingredients or take any special precautions.

But even in those countries of yours, several people must be deathly allergic to things, how are they going to avoid dying?

Again, we ve got free health care and people dont die or get that allergy thing here. Climate cant be because its quite similar minus the snow. Maybe inmigrant populations here were already used to those things while in the north not?
