[release]Bristol District Attorney C. Samuel Sutter today said he is seeking to charge two Department of Conservation and Recreation employees with criminal child endangerment for the chronic mismanagement of the Fall River pool where a woman drowned this summer and her corpse lay underwater, undiscovered, for two days. In a 20-page report into the death of 36 year-old Marie Joseph, Sutter said that there was no evidence that Joseph’s death was the result of intentional misconduct by public employees involved in the operation of the Vietnam Veterans Pool, even though his investigation found the pool’s operators routinely ignored state health and safety regulations, among other issues. “We have concluded that no individual act in the chain of events leading toMs. Joseph’s death, was wanton and reckless, in and of itself,’’ Sutter wrote. “A prosecution for the unintentional death of Marie Joseph can only be brought where the conduct that led to her death was reckless and wanton.” Without criminal intent on behalf of those who played varying roles in Joseph’s death, no charges can be brought directly related to her drowning. However, because the pool was reopened with Joseph’s corpse in the pool, Sutter said charges are warranted against top DCR managers. He said in the report that “after full consideration of al the events in this investigation revealed individual acts and decisions made subsequent to Miss Joseph’s death concerning the opening of the pool on Monday June 27, 2011, and Tuesday, June 28, 2011. We believe these acts and decisions constituted crimes.’’ He said Massachusetts State Police troopers today went to Fall River District Court and sought complaints of reckless endangerment of a child charges against DCR regional director Brian Shanahan and Jeff Carter, a DCR district manager for the South Coast. Sutter said in the report’s conclusion that “the investigation into Marie Joseph’s death revealed a systemic failure in the operations of the Vietnam Veterans Memorial Pool. A series of poor decisions with errors compounding errors and disregard for regulatory requirements and a disregard for the proper standard for operating the pool pervaded multiple levels of DCR supervision and management.’’ Three DCR employees resigned in July following an internal DCR inquiry, but their names were not released at the time. It was not immediately clear if Shannan and Carter are DCR employees today. Separately, Fall River Mayor William Flanagan moved to fire city health inspector Roger Casavant who inspected the pool on June 27 when Joseph’s body was still in the water, noticed it was cloudy, but took no further steps to assure the pool could be safely used by the public. I always thought that inspector had no possible excuse. If you can't see the body, that means you can't see the bottom of the pool. How can you then sign off on an inspection? You lie. If the bottom of the pool could be seen, then that means you didn't even really look in the pool or you would have seen the body. How can you sign off on the inspection in that situation? You lie.

I've worked at local government owned pool for the past several years. Our water is always clean and the lifeguards do their job more or less. Our airquailty is another story, but at least they're "fixing" it after the legal trouble... I'm literally breathing in poison. :( Everyone would have to be retarded to let something like this happen. Also, this is a giant re-toast.

If I was a kid and I found out I swam in a pool with a dead body just chillin in it I'd probably shit myself at the sight of any body of water.
2 days during what time, like a weekend? I mean surely if they had even got a glimpse of the corpse, they would have informed someone about it. I live near the pool..was not fun hearing all the sirens..and the crowds..and news reporters.
