While this site states my GPU could get 40-60 on max details (except no AA turned on.)

Maybe try to run it in admin mode?
Or maybe compatbility with Windows 7.

It's likely using your integrated graphics card. Go to the nVidia Control Panel - 3D Settings, and make justcause2.exe (or whatever) use the High-Performance nVidia Card.
Also make sure your house isn't on fire

Why does this have an xbox360 logo if this is about playing it on PC?

i7 870 has no integrated GPU, and almost no 1155 mobos have iGPUs. I know because mine is one of the only ones that does.
OP: Try backdating drivers a couple versions.

Well when my house burned down it also shut down the power so yes that happened as well
It could be something with Windows 8. Does it run fine on any other OS? Because I had a similar problem with COD:BLOPS where if I played it on W8 my framerate would dip to about 10-15 with heavy mouse lag but when I ran it on W7 it would be smooth in every aspect.

Yeah on medium-high i had 30-40 FPS, on Windows 8 i get 10-15 FPS on low and at the resolution of 1280x720.

I don't think it's this, I have a 570 and Windows 8 and JC2 runs fine.
Why is this happening? Just cause!
