Strange, I thought I remember there being bans given out to people who got a legit copy early out for games in the past. Or am I just completely wrong again?

They check the media on the disc. Any imperfections and BAM. Your banned. Or at least that is what I think they do.

As said once already, it bans by console. You'd have to buy an entirely new 360 to bypass the ban.

I imagine each disc has some kind of code that can be checked, multiple people playing with the same code is obvious they're on a pirated version.

Retail disc have a perfect copy and pretty much what they do is compare yours to theirs. When getting an illegal copy you must stealth the game. Which hides it from looking like an illegal copy. Since borderlands is not technically out yet people cant stealth the games properly and that is how MS knows if you have a retail or illegal copy.

Modding the Xbox itself doesn't get you banned. Its the playing illegal games that does.

I think MS sees that if they perma-ban an Xbox they lose that person money. So they just perma the account and make them pay for a new one. Which in most cases will happen.
This may not be true but hey others have been talking about it and I kinda believe it.
