Like, what are Interceptor and 3DR planning to get out of this? Unless Gearbox is blindingly incompetent, they would have a massive paper trail showing when they bought the IP and that they own it. Open and shut case in any court.
What in the actual fuck is going through their minds? What the hell is their play here? There's no way they think they actually have a shot at getting the rights to the Duke IP after selling it, there's got to be some other move they're going for.

It was the incompetence of the head of 3D Realms at the time that caused Duke Nukem Forever, and the license, to have to be sold off to Gearbox to begin with. This is ludicrous stupidity and a one-way trip to being taken apart in a court.
why would Interceptor do this? They can risk losing everything for something that they have no chance of winning. There is no possible explanation for this.

There is no telling why. Interceptor said they did their legal homework about this and they wouldn't risk killing their own company by being stupid. It perhaps could be something that happened behind closed doors. We don't get every piece of information when something like this happens because of trade secrets.
