Nintendo of America, Inc. has filed a takedown request under the Digital Millennium Copyright Act (DMCA), 17 USC § 512, for many of the fan games on Game Jolt that infringe on copyrights and trademarks owned by them.
We are required to act promptly on requests like this and remove any games included in the notice. When a DMCA takedown request comes in, we will "lock" any of the games in the notice.

This recent takedown notice from Nintendo included 562 games.
So what was that about Nintendo 'leaving most fan games alone'?
What the fuck is nintendo doing? Good job fucking over loyal fans
I'm worried for Mother 4 :suicide:
And don't bring up the "but theyll lose there copyrites" that's a hunk of bullshit

The lawyers don't speak public relations.
Holy shit, I think this is a new record. Of course, it means nothing for Nintendo since the creators did these games for free most likely. Really pushing all legal options that are available, huh?
most of these games i've never even heard of, nor the site. is nintendo actually worried about some random guy making a shitty RPG maker game with "zelda" in the title?
The lawyers don't speak public relations.
I mean in terms of Nintendo's defenders saying 'don't make remakes or try to go big or make money off your fan projects'.
This isn't exactly excusable beyond the principle of their copyrights anymore. I'm assuming once fans kicked a stir with AM2R and Pokemon Uranium, their lawyers began looking up other things to strike.

Smash Bros Crusade was there, that was a fairly popular one.
Good thing the Game Maker Sandbox went under or else they would've had a field day taking down a good chunk of the games on there.

did they?

They also have to protect their trademarks and copyrights otherwise they loose them.
Yea it's a dick move and could be undone by Nintendo but right now if you are using a Nintendo IP for a fan game, I would be going dark and pulling it off for a few weeks until this shit blows over.

Unrelated to Nintendo but related to that site, pac0master is attempting that ship sinking simulator again.

Well this pretty much flipped my perspective of this whole thing.
Nintendo is definitely in the right here if money was being made.

Hoo boy. I was going to try to defend the games here, but if the numerous devs tried to take advantage of that in full knowledge that it's infringement, then that just utterly flips the entire case right over on its head.

A lawyer came out and said it doesn't work like that

Only trademarks have to be protected, copyrights are fine. Nintendo are willingly going after these people, although they are within their legal rights.
Is the SNES Link To the Past style Ocarina of Time still a go or has it been shut down too
Is the SNES Link To the Past style Ocarina of Time still a go or has it been shut down too
that was cancelled like a decade ago i'm pretty sure
Here you go Nintendo: http://www.xbox.com/en-us/developers/rules Copy that.

Takedown was aimed at GameJolt itself
The web site at gamejolt.com generates revenue from advertising banners displayed on the site and advertisements played while users wait for the games to load.
Which kinda sucks if you did make a game for free, and it gets taken down just because it was hosted on a website with ads.
Also gotta love how there's at least 24 "Five Nights at x" games in there
Smash Bros Crusade was there, that was a fairly popular one.
[sp]Strangely that's still up and not in the DMCA list[/sp]
Not to lighten the seriousness of this issue directly, but I got a chuckle out of the name of one of these taken down:
"roguelike-pokemon-horror-open-world-zombie-shooter-slender-survival-mmo-extreme-2-turbo-super-hd-remix-deluxe-gold-edition-reloaded-snoop-dogg-craft-erryday-video-game"

Since the takedown was aimed at GameJolt there shouldn't be anything stopping these devs from hosting their fan games somewhere they don't automatically make money on them.
GameJolt definitely isn't in the right here. I've seen numerous games obviously ripping off a Nintendo IP (e.g. Pokemon in 3D was a popular one IIRC) right on the front page of the site, generating lots of clicks and lots of ad money.
If you're living in Russia you can blatantly disregard almost any copyright (not Russian one of course), and even charge money for your creation - there nothing license holders can do to you. (Nothing legal of course)
And the best thing, you'll even be heralded as "hero" who fights corporate oppression.
thanks nintendo love you too

IIRC I think the lead creator of the Mother series said he was okay with the team making it and if it was good would consider it a part of the series. But I could be wrong :pudge:.

He did say that though it doesn't matter since Nintendo has the most say in it anyway, I guess.
I'm worried for Mother 4 :suicide:
I checked out their reddit immediatly and they seem fine for now, I guess in case of being taken down they'll just redesign Mother-related stuff.
Is there a reason for Nintendo being such dicks towards its fans or is it really just a case of some suits round a table trying to out-do each other on the dick-scale because they're so rich anyway that they don't give a fuck and do it because they find it funny?
Unrelated to Nintendo but related to that site, pac0master is attempting that ship sinking simulator again.

That's pretty cool to see, since there don't seem to be any wildly overreaching promises around this time.
The game even seems to use more GPU processing now, so it should run faster on systems that support it.

Pretty much, they have no legal obligation to do this.
Sega officially let's people upload romhacks on the steam work shop for fucks sake.
This is getting ridiculous.

What, people being surprised that using a big company's established IP without permission gets them C&D'd? What a shock.
Daily reminder that yes, trademarks (not copyright) have to be aggressively defended to avoid genericization. If you want to use a company's IP without authorization, don't be surprised if you get a friendly letter in the mail advising you to stop immediately or face legal action. If you make a fan project that avoids infringing on trademark you'll have no issues.
