Okay, so my cousin, aunt and I are all on a non-smartphone plan with a 2 year contract. I want to swap my sim card from my current phone to my iPhone 3G. I know if I do this they will find out and start charging us a data plan, but will they make me pay a cancellation fee since I am on a contract?

I don't there's a way for them to find out what phone you're using. I'd just put the simcard in the iPhone and stop worrying. But then again, contracts work differently here where I live compared to USA (Where I assume you live)
You can use the phone functions (Calling/texting) without them charging you for any data. If you use data when you're not on a plan, they'll charge you a ridiculous rate.
The phone and texting will work just don't use any data consuming applications, it probably won't even let you use data.
Also what carrier and country?

Some companies will put you on the cheapest data plan. I suggest you ask and see how you can keep it out of the contract.

My parents are all super strict about not getting data plans for their iPhones. Years back, when I'd run up the bill by using internet, my parents blocked the use of data on our account, so when they purchased used iPhones it never thrust them into a data plan. AT&T will show you using an iPhone on the site, they just won't charge you for a plan. If you upgrade through the company, they'll force you to sign up for one saying your phone won't work unless you do.
