• White Connecticut Firefighters given promotion as Sotomayor's decision is overturned

The high court ruled in June that New Haven officials violated white firefighters' civil rights when they threw out 2003 test results in which too few minorities did well. The case became an issue in confirmation hearings for Supreme Court Justice Sonia Sotomayor, who ruled against the white firefighters when she served on a federal appeals court. Fourteen firefighters who sued are being promoted Thursday to lieutenant and captain. Another 10 firefighters, including four minorities, who took the 2003 tests but were not plaintiffs in the court case also will be promoted. Dennis Thompson, an attorney for black firefighters who tried unsuccessfully last month to block the promotions of the plaintiffs, said Wednesday that his clients congratulate the newly promoted firefighters. "Nobody is going to say these guys are unqualified," Thompson said. But Thompson, who is trying to intervene in federal court in New Haven to challenge the validity of the exams now that they have been certified, said the fight is not over because the black firefighters were not heard. In other cases cities have been required to make more promotions than planned, he said. "They understand this is a 15-round fight," Thompson said of his clients. "You don't decide who won in Round 3." That prompted an angry reaction from Karen Torre, attorney for the white firefighters. "Attorney Thompson's provocations and promise, to me, only demonstrates the need for the Supreme Court to take up the issue of the constitutionality of that provision of Title VII that allows such people to paralyze local governments and the civil service and hold the public hostage to endless litigation over the issue of race," Torre said in a statement. David Rosen, an attorney for a black New Haven firefighter who is suing the city and arguing he was unfairly denied a promotion, said Wednesday that his client, Michael Briscoe, is happy for the firefighters being promoted and has congratulated several of them. "He's not trying to take a slot away from one of the people being promoted," Rosen said. "There are other vacant positions." Frank Ricci, the lead plaintiff among the white firefighters who won and is being promoted, told the Senate in July during Sotomayor's confirmation process that the lower court ruling against him "divides people who don't wish to be divided along racial lines." Ricci told the panel that "achievement is neither limited nor determined by one's race but by one's skills, dedication, commitment and character." Is there some more backstory here, because I don't really understand what happened. Some blacks were upset that white firefighters got a promotion while black firefighters didn't so they sued? Or am I misinterpreting?

The white firefighters sued because because they didn't get a promotion for doing well on a certain test because not enough minorities took the test, so the test was ignored.

Or am I misinterpreting?[/QUOTE] Out of a large selection of firefighters, a or a couple of black firefighters were chosen to be promoted and all of the white firefighters, who had exceptional scores on their evaluations, were all rejected because the district ruled that there weren't enough minority firefighters being promoted. The white firefighters felt they got gypped, so they filed a lawsuit. Not to say the black firefighter(s) didn't have the qualifications, but I personally find it disgusting the level of affirmative action running rampant in this country. I look at it like a smooth road of equal tolerance running straight into the sunset; on either side, bottomless pits of meatgrinding creatures; on one side, racism, on the other, affirmative action. Both are discriminatory. We need to get away from both.

A federally appointed judge appointed for life in New Orleans recently ruled that a school district had to hire black people for ALL administrative positions until a 2:3 ratio of black:white was met. A lady I know may not get a job because of this. She is applying for the head of the parish's school transit, and is very qualified: She has 20 years experience as a business owner, 10 years as a bus driver, she is a certified in bus driver instruction (for 7 years), she is experienced in route planning, she knows every bus driver, and she has a business degree. One of the other candidates has a masters in teaching (Nothing else of relevance). Just looking as these facts you would obviously choose the more qualified. But, the judge's ruling could negate that.
And once again the so called "solution" to racism in employment only ends up causing more discrimination in the end. Affirmative action has done more harm than good. Shouldn't we try to educate disadvantaged minorities rather than just force them in to jobs or colleges that they would have trouble with?

Anyone can be racist regardless of class, race, and gender. Just because someone called Sotomayor a racist doesn't mean he believes that the Hispanics and Blacks are all trying to persecute him now, it just means someone in power is racist, and happens to be of Latin origin.

What is so special about them being fire fighters? Practically anybody can become one.

There isn't really any reason why a firefighter would have to be in good shape, just able to pass physicals and stuff.

A fat out of shape firefighter could be much more useful if he knew his surroundings and thought quickly, rather than a nervous, quirky, healthy man.
