The [B]only[/B] justifiable reason to sue was that the uncovered manhole was not marked. As far as I'm aware there are regulations requiring that they are marked. However, all the defense would have to do is say it was marked. It would be the City's word vs. the Girl's then, and seeing as how she wasn't paying attention it would hold some ground.
I wish news sources like CNN, MSNBC and Fox would start using phrases like "Dumbass Bitch" in headlines.

Reminds me of the teenage girl that was hit and killed because she was texting and walking through a parking lot, and a teen boy driving a rather large truck was also texting and didn't see her.
Also reminds me of those two teenage females who got ran over while tanning.

I fell to a manhole at age of 6, was during winter and it was covered with snow. Got out hour later when some guy heard me in there. Also it was 2x my height, i didnt sue anyone nor did my parents think about it.
