Knowingly exposing others to HIV will no longer be a felony in California
Gov. Jerry Brown signed a bill Friday that lowers from a felony to a misdemeanor the crime of knowingly exposing a sexual partner to HIV without disclosing the infection.
The measure also applies to those who give blood without telling the blood bank that they are HIV-positive.
Modern medicine allows those with HIV to live longer lives and nearly eliminates the possibility of transmission, according to state Sen. Scott Wiener (D-San Francisco) and Assemblyman Todd Gloria (D-San Diego), authors of the bill.
“Today California took a major step toward treating HIV as a public health issue, instead of treating people living with HIV as criminals,” Wiener said in a statement. “HIV should be treated like all other serious infectious diseases, and that’s what SB 239 does.”
misdemeanor?
so that's, what, one year for knowingly infecting someone with an as far as i know functionally incurable disease?
??????
Holy shit this is fucking moronic.
Why is it always fucking California
Knowingly exposing somebody to an inevitably fatal disease with no cure that will ruin your life is no longer a felony, god help us all :downs:

Or basically: "We have a bunch of pills now and it doesn't hurt as much anymore so it's no longer a real crime to kill someone with your fluids."
I fucking hate this state so much
The measure also applies to those who give blood without telling the blood bank that they are HIV-positive.
Holy shit how did this happen
People in this thread seem like they don't read. How is fucking someone when you have in-transmittable HIV so there was a statistically insignificant risk of them getting it so much worse than say, exposing someone to the bubonic plague? The law has literally just been adjusted so that the penalties for HIV are in line with other infectious diseases instead of singled out with worse penalties because of stigma.
if you give blood while knowingly having HIV you should be put away for a very long time imo
even if you have some minor cuts/scrapes you shouldn't be donating, if you donate blood while deliberately withholding that you are HIV positive you should be locked away for years, maybe more

because HIV is uniquely different compared to other diseases

their line of reasoning would be a lot better if the US had single payer healthcare and whether or not you can afford the drugs isn't a concern.

Here's the thing
1) HIV when it progresses to AIDS, as it stands now, is universally fatal
2) These idiots even decriminalized HIV positive persons knowingly donating blood or blood products, which according to every piece of medical literature and international guideline we currently have, says that nobody with the infection should be permitted to donate blood for this reason.
3) If you end up becoming HIV positive yourself, your life's just as ruined as the guy who you got it from

The bubonic plague can be treated with antibiotics
AFAIK herpes is the same way here, which at least makes SOME sense, but HIV??? They should at least be liable to pay their medical expenses like...damn
You better hope you guys don't need a blood transfusion while in Cali.
there's nothing good about either side of this problem. HIV is not a death sentence but it certainly is still very deadly, but i can see why a felony for not informing a partner about their HIV when they could be non transmissible.

Knowingly inflicting anyone with any incurable disease could be a felony.
They've done the exact opposite to what they should've done here.
Holy shit this is fucking moronic.
"Oh guys it's okay, you can just get pills for it!" is what people say, but do they not remember that this is America? The land of "spend your entire salary on medicine"?

I bet you wouldn't be saying that if you're on the receiving end of the stick.
Regardless what people say, the risk is never 0 and you should always disclose
If someone is medicated with "near intransmissable" the chance of it happening still exists, and them being medicated won't make your hiv "less bad"
it is incredibly selfish for someone to not disclose to their partner if they are positive, even if medicine minimizes risk of transmission

Because the Bubonic Plague doesn't stay in your system forever, can be killed with antibiotics, and doesn't give you fucking aids.
For what fucking purpose.
Because california has the most "feel good" legislation of any state in the union.
Full blown this is being made so that people with HIV don't get their feelings hurt.
People with HIV, no matter how they got it, should always disclose their condition, and should NEVER give blood.
Holy fuck California is a state of morons

Do you know how expensive it is to get the medicines for HIV/AIDS these days?
also just as an fyi: if the opportunistic infections wont kill you, you can also expect a chance of getting several kinds of cancer, which don't get treated for cheap.
Land of the free, home of medical bankruptcy
God help anyone who has to receive a transfusion when in California. Imagine getting your life ruined because some selfish prick decided not to disclose the fact that they have HIV
This is coming from the state that religiously claims every single item you buy in stores has a chance to give you cancer
-repeating self-
I hope to God I will never need an emergency transfusion.
I hope to God I will never need an emergency transfusion.
There should be a travel advisory if people want to go to California now. "If you get injured and need a blood transfusion, you risk having to spend thousands of dollars on medicine, or possibly getting a death sentence"
Honest to god

Attempted murder should be the charge, honestly. You are willingly risking someone's life.

An STD that fucks up your immune system isn't "in line with other infectious diseases" and I doubt HIV-positive folks are stigmatized and discriminated against just for being ill. Sexually repressed, maybe, but that goes for all STDs. Intentionally exposing someone to HIV should be a crime, as would be intentionally infecting anyone with any terminal illness. And no, all the medicine in the universe doesn't remedy that. The odds of transmission could be 0.001% and it wouldn't matter. You can have sex using the pill and get pregnant, you can have sex using HIV meds and transmit HIV. Not to mention you need to buy these meds in the first place, which encourages big pharma to price gouge, leading to a shittier outcome for everyone involved than just not exposing people to HIV.
