The Australian Competition and Consumer Commission (ACCC) has taken Federal Court action against Apple for what it says are misleading claims about the connectivity speed of the latest iPad. Apple's barrister Paul Anastassiou told the court there were networks in Australia that were equivalent to overseas 4G networks. He said by international standards Australia's 3G networks are actually 4G and that they should not be bound by Telstra's definition. But he said the company was prepared to email customers to say the device was not compatible with the Telstra 4G network. Mr Anastassiou also said the company was willing to offer a refund to any customer who believed they had been misled by references to 4G. ACCC barrister Colin Golvan SC said the tech giant was warned by the consumer watchdog before the device went on sale that it's advertising was misleading but went ahead anyway. Mr Golvan told the Federal Court that Telstra is the only network offering LTE 4G in Australia and the new Apple iPad is not compatible. "Apple doesn't have an iPad that would meet consumer requests for an iPad that would use a SIM card to connect to a 4G network," Mr Golvan said. "They knew it wouldn't connect." Justice Mordy Bromberg heard the ACCC and Apple tried to reach a compromise but couldn't agree on how information should be conveyed to consumers. Mr Anastassiou said Apple was prepared to say that the iPad 3 is not compatible with Telstra 4G but does not want to say it will not work on ultra fast mobile networks. We got an iPad HD 4g model knowing we'll be stuck with Telstra 3G. It is still a shame we can't get 4g tho :(

We can get pretty fast internet now: [IMG]http://i.imgur.com/mrqkF.png[/IMG] It's just limited to cities really, we still have bad upload speeds (I think?) Also our mobile internet is a joke, in my own experience, if you are with any carrier apart from Telstra, you get terrible reception and mobile browsing is pretty much impossible

I doubt anyone would refund anyway, chances are anyone with the new Ipad bought it because it's an Ipad, they probably didn't care, let alone know about it's so called 4G capabilities.

Thus this iPad can't connect to Telstra's 4G network (note, Telstra's definition of 4G) because the iPad wasn't made for it. Learn to read.

The best I can get in my area is 800KB/s (I do live in a rural kind of area though), and even then I reckon that's acceptable (except for night time where it might slow down to less than half of that). Sadly TPG (or no provider for that matter) offers ADSL2 in my area.

I would really like a 4G-connection to my Galaxy S2. I have 3G now at "networks unlimited maxinum speed" and the best I've gotten here has been 512kb in the city center. Meanwhile my sister has another service providers 3G that always goes to the mininum of 2mb in the middle of an uncharted area of Finland.

Learn to read.[/QUOTE] It's really quite funny, the iPad 3 can do HSPA+ or LTE, both of which are transitional "3.9G" (better than plain 3G, not good enough for 4G) specs that the ITU says can be called 4G. Telstra is running an LTE network, but on a different frequency than what the iPad 3 wants (because here those frequencies are reserved for TV broadcasts.). So Telstra is calling their 3G network 4G (Which the ITU says is fine) and Apple is calling their 3G device 4G (Again, the ITU says that's fine), but because they don't work together they've decided Apple is being misleading. Edit: Really, no party is right or wrong, it's just a matter of who blinks first (Apple blinked)
I don't think mobile internet should be defined as 3G, 4G and so on. It's so confusing.

Apple deserve everything they get. They are taking advantage of people that do not understand (nor are they explaining at all) that the iPad does not have the frequencies used in Australia for 4G.

That is deception. Which is why the ACCC is taking action against Apple. Nothing to do with Apple not meeting "one of hundreds of carrier's definition of "4G""

I share a 3mb line with my 4 other family members and one of mom's friends. Each member has at least one hostname with myself having 3 (desktop, laptop, and phone), and my father having... (starts counting) at least 5 (his laptop, machine downstairs, his phone, fileserver, second fileserver, and whatever machine is on the workbench at the time). We'd have a better connection, but we live in the middle of nowhere and I'm fairly certain that our provider is the only one that reaches out here, hence... no market incentive to increase performance. Oh! We can upgrade to a smoking hot 5mb line! ...for the same price that we're already paying? Come on dad...
