(CNN) -- The Obama administration will fight to preserve the law establishing an annual National Day of Prayer, the Justice Department confirmed Thursday.
A federal judge declared the law unconstitutional last week.
The Justice Department's official filing of a "notice to appeal" Thursday came as no surprise, after White House spokesman Matt Lehrich said following the ruling that President Obama intends to recognize this year's National Day of Prayer, which is May 6.
U.S. District Court Judge Barbara Crabb in Wisconsin ruled on April 15 that the 1952 law creating the National Day of Prayer violates the ban on government-backed religion.
The ruling produced predictable reactions, with most religious groups sharply criticizing it and groups backing a strict separation of church and state applauding it.
The injunction against the National Day of Prayer would not take effect until the appeals have been exhausted.
The case is Freedom From Religion v. President Barack Obama, White House Press Secretary Robert Gibbs, and Wisconsin Gov. Jim Doyle.
Obama does something conservatives might approve of. :aaa:
He's going to piss off a lot of Atheists, that's for sure.
separation of church and state... it shouldn't legally have been passed anyway
Bad idea.
If it doesn't back a particular religion and pulls for a day of "general prayer", I would think it could be considered nonspecific and separation of church and state may not apply, but that's just my opinion.
Either way it's not really a good idea to try to institute something like this, it's just gonna stir shit up.
omg he's gunna bring day of prayer the whole country is doomed!!!!!

In backs religion, which is obviously not separation of church and state.
Fuckin' why? This doesn't seem like something they would support.
omg he's gunna bring day of prayer the whole country is doomed!!!!!
Stop it. It's unconstitutional and thus does not belong in this country.
This just seems like a complete waste of a days tittle. Why not make it "National Logic Day" or something. "National Robot Wars Day" would also be acceptable.
:obama:
Pray or die!!!
I feel like he's only doing this to get on the good sides of some people.
In backs religion, which is obviously not separation of church and state.
Well a lot of things back religion that the government does, you know, like the Pledge of Allegiance and money? It's just nonspecific. It says "in God we Trust".
Though on second thought, plenty of religions don't have a god.
Welp I dunno v:v:v
I don't see the big deal about this. There are a lot of stupid "National ____ Days" I don't why this one would be any stupider.
I feel like he's only doing this to get on the good sides of some people.
No, really?
I feel like he's only doing this to get on the good sides of some people.
This. I doubt Obama is very religious, he wasn't raised in a home with any particular religion, he's probably an agnostic or something.

He's a Christian, look it up.

tbh, I think he's religious. Albeit, not very.
If people are going to bitch about this, I can't see why we don't just cancel Christmas as well.
If people are going to bitch about this, I can't see why we don't just cancel Christmas as well.
Because Christmas isn't a national holiday.
Atheists need to stop bitching. It's not like it's a law forcing you to pray, it's a holiday honouring prayer and religious/
it's also pretty secularized as is

@david
If the government makes all holidays entirely secular, they're being biased to Atheists, thus making things inequal. Having religious holidays isn't a big deal.
By the way, those who keep spamming "separation of church and state", there's a 95% chance that you don't give two shits about that issue and are just saying that because you're Atheist.

If it violates the Constitution then it doesn't belong here.
Because Christmas isn't a national holiday.
Nobody's forcing you to stop drop and pray. Go to work, come back, entertain yourself for several hours, and go to sleep like any regular day. The fact that something nice is being done for people you dislike should not bother you, but it does, so the issue is with you.

Correction: they're following the Constitution. By making religious holidays you're violating the Constitution AND being biased towards non-religious people. You can still pray and shit if you want to. The government just won't be involved.

or anyone who believes in the Constitution
:obama:
I don't particularly care about this at all, whatever, however
If it doesn't back a particular religion and pulls for a day of "general prayer", I would think it could be considered nonspecific and separation of church and state may not apply, but that's just my opinion.

no, it's unconstitutional. violates the second and third prong of the Lemon Test, advances religious causes, and it also is showing an entanglement between the church and the state
I mean this is establishing a purely religious national holiday, it's pretty clear to see that it violates the constitution
In backs religion, which is obviously not separation of church and state.
Nothing about the separation of Church and State ever says anything about the government being unable to recognize religion. They're not backing any particular religion, and not forcing anyone to do pray either. It's a day with a name- it's really quite pathetic that anyone should make a big deal about it.
I'm glad they're fighting for it. Even though i'm sure it'll negatively affect sooooo many people if it comes through.
