People who want to keep Windows up to date I'd imagine. Or people with Windows tablets. I have to admit there's a few problems with Windows 8 at the moment, but I think that's safe to say it happens with every Windows release. After a few months most of the major bugs should be ironed out

Does it fix the faces lagging and stuttering up?
Because it did that with my copy, and for a game with that as their critical element, It kinda defeats the purpose if it's fucking up for me.

The facial animations are locked at 30FPS, I think. It's probably just that, it looks kinda weird when the rest of the game runs at 60.

There was always something off with the facial animations, even though they look great. I could never quite put my finger on it.

You could have also just been seeing the Uncanny Valley effect (The whole "It's meant to look human, but it doesn't look human enough so it just looks weird and creepy" thing, you can look it up if you don't know about it), which was also even more prominent in L.A. Noire due to the face textures being pretty low-res and not quite matching the body on a lot of characters.
The PC version is also meant to be locked at 30 FPS, but for some reason a lot of people are able to play at 60, which (as stated) fucks with the facial animation. Not sure if it's a previous patch that fucked that up or if it can be fixed (I haven't really followed the PC release too closely), but yeah.

I think it's the fact that the eyes don't really always look where they should... it's a big limitation of their facial animation tech
