Lawrence County Judge John Hodge found Brown delinquent, the juvenile court equivalent of a guilty verdict, in the deaths of Kenzie Houk and her unborn child in New Galilee, Pa. in 2009.
The verdict means Brown could remain in juvenile court custody until he’s 21. Whether he remains incarcerated in a juvenile facility that entire time or is eventually released on probation will be subject to future hearings on the state of his rehabilitation.
He has been held in a facility about 80 miles from his home for most of the three years since he was charged with criminal homicide.
Brown originally faced the possibility of life in prison without parole if convicted in an adult court, where state officials first filed the charges – as is required in Pennsylvania homicide cases, regardless of a defendant’s age.
The boy and his supporters insisted he is innocent.
Prosecutors said that Brown took his 20-gauge, youth-model shotgun and killed Houk, 26, moments before he left for school with her 7-year-old daughter. Investigators have suggested Brown was jealous of Houk’s unborn son, who died of oxygen deprivation after she was shot, execution-style. Houk was more than eight months pregnant when she died.[/quote]

Cases like this make me wonder about those laws where killing a pregnant woman is double murder.
So the guy was supposedly jealous of an unborn son?
I remember when this happened, and Facepunch had a huge argument about children getting away with murder.

No one should get away with murder, unless there was a large chance that it was an accident, the charges should be harsh, a life is a life, and it's being taken away, they had hopes, dreams, goals, and family. The effects hurt a lot of people, its one of (besides major war crimes and crimes against humanity) worst things you can do. I could bring in the death penalty, but that's always shitstorm central, so not this time.
Their reasoning as to why seems BS-ish.

I say it should be case-by-case whether or not it's a double murder.
Because of how people are it probably would be most of the time but you never know, sometimes it might just be a one-person murder.

but rehabilitation bridges those gaps that are created through tragedy so much more than just throwing a life away

Though I agree with that you can't ignore the fact that he was 11. Younger kids do loads of stupid shit. I'm not saying he should get off for that but at least punished until he turns 18 or something like that. Thinking back when I was his age, I did so many things I regret that I would NEVER do now. There's also possibility of mental problems and stressful living environment that can drive even the most perfectly normal people crazy.

Wouldn't be the first time a child with a gun that's designed for kids shot his friend or himself over something retarded.
I can understand the reasoning behind his actions. Babies to get a lot more attention and second child kinda gets forgotten. Though that does depend on parents but it's not a rare case when that happens.
Note I never said this excuses his actions as they're totally fucked up.

But why is there a youth one? A generic shotgun is just fine. I've been hunting with a double barrel shotgun since like 6. With supervision of course.

And this is probably a smaller version of a pump action shotgun, with a smaller stock and a handle designed to fit a smaller hand, along with a easier action and lightweight barrel?
What is the big deal? Guns, especially shotguns, are not one size fits all. That's fantastic you were a capable at the age of six, but just because you could handle a full size firearm doesn't mean the option shouldn't be there. Why don't you complain about youth size motorcycles? Or is there a difference because they are 'weapons' that kids shouldn't have(except you've apparently been hunting since you were six..)?
This is a really sad story. The kid needs rehabilitation and the dad needs to be brought up on charges for leaving him with a shotgun when he obviously didn't understand seriousness of it. The last thing I want to do, however, is to start charging people for double homicide when killing a pregnant mom because then you solidify the abortion argument. You're either a person when you are born, or when you are conceived.

[/QUOTE]My bad I apologize. I didn't realize they were called youth for that reason. I thought they were called like that because they were supposed to be given to kids. Sorry didn't realize that as I've never seen or heard about youth version guns before this thread.

I think everyone does stupid shit when they are younger, but even at eleven you should know that shooting a pregnant woman in the back of the head is fucking wrong.
Something tells me that there is more to this than him just being jealous. Kid's don't just kill people for nothing and I doubt it was for fun.

If you don't want to make the killing of an unborn child homicide, then make the charges for feticide be the equivalent of a homicide. Its basically the same but there would be a legal distinction.

There are youth sized motor cycles
Absolutely horrible what he did, and he should be punished for it, but life in prison isn't the right way to go. He was 11. Let him serve some time, but life? Not a smart move in my opinion.
There's a huge difference at 11 years old between understanding something is wrong or naughty, and understanding the full consequences of your actions (in terms of the legal severity).
