I have even more instances that make me not trust cops.

This is messed up.[/QUOTE] No, it's referring to vicarious liability, i.e. the liability of the employer for an action in tort (i.e. negligence, trespass etc). In Victoria, police are being protected from being sued individually (as a person), provided they were performing in their duties. [URL]http://www.austlii.edu.au/au/legis/vic/consol_act/pra1958187/s123.html[/URL] The result of this is that if you sue a police officer that was doing their job as prescribed, then their personal assets are protected from the suit, instead, any money that is awarded to the person suing (for the wrong doing of that police officer) is to come from the State of Victoria. The problem here is that clearly an assault (without cause) is outside the bounds of the duties, and she was suing the police officers for an assault. The problem is, they had trouble proving the assault occurred on a balance of probabilities (standard of evidence required in a civil case), and therefore would have no luck in proving that there was an assault beyond reasonable doubt (criminal case) - [URL="http://www.austlii.edu.au/cgi-bin/sinodisp/au/cases/vic/VSCA/2002/177.html"]The actual case, see paragraph 10[/URL]. Police are not immune to prosecute for criminal offences at all - the problem was they couldn't be proved. The legislation regarding immunity has since been [URL="http://www.austlii.edu.au/au/legis/vic/num_act/vpa201381o2013210/s74.html"]changed under the Victoria Police Act 2013[/URL], and will come into effect on 1 December 2014.
