Half Life 3 is a bad example since everyone is going to buy it regardless. The next Aliens game, Evolve, Far Cry 4 - they're better examples.
I only ever pre-order games from developers that I trust. CD Projekt Red and 4A Games to name a couple, I'll never ever pre-order a ubisoft or EA product until those companies earn my trust back by not sectioning off their games as dlc or releasing what they promise/show. I didn't pre-order colonial marines but it sure as hell hurt my trust in Gearbox.

But this is justice, they are paying people back the money they spent if you fill out a thing which is just for to prove you bought it before the release date. What did you expect to happen to Sega? Hell we dont even know if any of it is there fault, to me it seems far more on Gearboxes side.
Segas paying out and sucking it up because they dont wanna risk some long drawn out case that ends up costing them shitloads more for attorney fees, when instead they could settle with the class action lawsuit, pay people back, and be done with it.
I would say justice was served, but more needs to happen to Gearbox but they are still in it so lets see.
