Patents were originally provided as a protection for the small business man to not be overrun by the bigger companies. That to me is valid.
But now days, the patent office is no longer government funded so they take a big fee when filing a patent. Making only the bigger companies with the money able to use the patent system. Plus lets not forget the massive fees to protect your patents. And the other big problem is that they allow very retarded patents to go through. Like for example Slide to Unlock or the Wedge Shape.
Patents should only be allowed for VERY specific things in my opinion. And only as a way of protection and not in the sense Apple uses it.
Both of you are wrong. Actually, patents were created to advance the technology and excluding software patents, they're doing their job just fine. A patent is basically a contract between the inventor and the government where the government gives the sole right of use to the inventor in exchange for the disclosure of technology used in the invention (in a way that anybody can remake the invention). After 20 years, the patent expires and everybody will be able to use that technology for free.

All those things are such incredibly basic and stupid things that should not be patented.

Patents for normal stuff are doing their job. Software patents aren't. To be honest, however, in order to get a patent, your creation only needs to be the first of its kind and writing a program to meet that criteria is relatively easy.
It's good to know that even if Apple loses, they can still make jokes about originality.
