• Lugaru (Indie game) stolen and resold on the Mac App Store

Some scammer has taken the Source Code for Lugaru HD, an indie game developed by Wolfire. The Source code was released along with the Humble Indie Bundle as a way for modders and coders to get a nice look into the development of the game. NOT for redistribution. Now this bastard who calls himself iCoder is selling Wolfire's game, next to their own release on the Mac App store for $0.99! The fact that Apple didn't even bother to check that this is indeed a stolen game that they are putting up is sad in it self, but them not removing it after several days is even worse.
This is a kind of software fraud we've never even heard of: a pirate simply downloading the app and resubmitting it to the same distribution channel at a lower price. We immediately emailed Apple explaining the situation, expecting them to quickly investigate the situation, shut down the fraudulent app, and follow up with us. We started this process a few days ago, and haven't heard back from Apple yet.
Link to the original article by Wolfire
iCoder was very unhelpful in response to our emails (their feedback form doesn't seem to work), but Kotaku managed to get an interesting comment for their article, they responded "we have every legal right to market and sell the software" and, "the license we were granted allows for non-exclusive redistribution of the source code or the compiled product, modified or unmodified, for a fee or free of charge."
Wolfire are known for promoting Open Source code and encouraging other developers to do the same. However it clearly says that it isn't freeware, meaning that people can simply steal the code and sell it. This is a sad day for Indie Games.
Gotta love how the $0.99 one still says HD on its icon and they still didn't notice
Gotta love how the $0.99 one still says HD on its icon and they still didn't notice
I don't think they let the game in the app store because it did not have HD in its name, they just didn't bother checking if there's another game named like that at all.
What a cunt.
People who do shit like this for profit should be exterminated.
That sucks, Wolfire is cool :<
What the fuck?
It would have been perfectly fine if they put it up on the store for free so others could play, but putting it up for a price when you didn't develop the product is immoral.
It would have been perfectly fine if they put it up on the store for free so others could play, but putting it up for a price when you didn't develop the product is immoral.
No it wouldn't have, Wolfire doesn't want it redistributed. And putting it up for free kinda undermines Wolfire selling it in the app store in the first place.
What a cuntish thing to do. Fucking fucker. :sigh:
Because the group released the source under the GPL, anybody has the right to re-compile the code and release it (for free or for cost) But, that doesn't mean they can use the same name. But the law there is a bit grey (In the US, anything you create is copyrighted to you automatically, but you still need to register it if you want to take it to court or fully protect it)
It's not like Wolfire is losing profits.
I think that the best thing that we could do would be to: A. Send a few messages Apple's way, show them that Wolfire has our support, or B. Everyone buy a copy of Lugaru from Wolfire :D
B. Everyone buy a copy of Lugaru from Wolfire :D
I bought Lugaru before it was in the Humble Indie Bundle /hipster-cred
Disgusting.
It's not like Wolfire is losing profits.
Even if that isn't the case, Apple is showing an enormous incompetence.
[editline]f[/editline] I stated that the GPL allowed this, but I was wrong; it's still illegal. Only the code is GPL. Everything else is an infringement (maps, models, textures, etc.)
Wolfire is the game development group I support the most of all of them, both independent and sponsored. This is completely outrageous. The guy should get sent to court. And Apple right now massively lost in my eyes, too.
No it wouldn't have, Wolfire doesn't want it redistributed. And putting it up for free kinda undermines Wolfire selling it in the app store in the first place.
Hey but wait why is it OK to do it for Ubisoft's games? [editline]3rd February 2011[/editline] I just wanted to test it don't worry I wouldn't buy it otherwise.
No it wouldn't have, Wolfire doesn't want it redistributed. And putting it up for free kinda undermines Wolfire selling it in the app store in the first place.
So why do people on this site support piracy in other situations?
[img_thumb]http://cdn.wolfire.com/blog/a/apple_pirate.png[/img_thumb]
That pirate guy looks pretty badass, tbh.
So why do people on this site support piracy in other situations?
Because these Indie devs. aren't "evil corporate capitalist pig-dog oppressors" like the bigger companies are, so they are above the normal rules.
Because these Indie devs. aren't "evil corporate capitalist pig-dog oppressors" like the bigger companies are, so they are above the normal rules.
But I thought most people would pirate a game to test it and see if they would want to buy it. You know, extended demo.

Kill this asshole
brb Buying Cheap Lugaru.
Kill this asshole
Wow, you should see a professional.
Nothing commercial should ever be released under GPL, unless you want to compete with other people selling the exact same thing (i.e. linux distros that sell tech support and physical media for a free OS).
Ugh re-read Wolfire's blog. The source code is GPL, but the assets are NOT. They aren't allowing anyone to just copy the game wholesale.
I bought Lugaru before it was in the Humble Indie Bundle /hipster-cred
Same, though I bought HIB because I could :3:
So why do people on this site support piracy in other situations?
Because this guy is actually getting money from this.
