Interesting law. At it's core is the idea that the prisoner has to pay for their imprisonment. So obviously any assets the prisoner owns, or shares, become fair game for the government. So yeah, her share of their assets would have to be given to the state. He's not really losing anything when you think about it. Assuming a divorce means they split their assets, then either way he loses half. Either to her, or to the state. Unless family law says that in a situation where the wife or husband murders the family, the surviving spouse gets everything.

He loses 5 kids to an insane ex-wife, and now they're punishing THE MAN? Seriously, they should be giving him money to help him during this time. He shouldn't have to pay the cost of the woman's execution.

She is still alive, therefore she's entitled to her share of their assets(like a house). I don't know Belgian family law, so I don't know what portion she's entitled to, but in California it would be half(as an example). Therefore, the state may claim her portion. He did not inherit her share, since she did not actually die. So if they ask for her share they aren't taking anything from him that he wasn't already going to lose. What he's asking for is to be given everything, including his wife's portion of their assets. So he's saying "she killed the kids and is in prison, let me have everything and start a new life". Not so fast buddy, what she did was evil and she deserves every bit of punishment coming her way, but that has nothing to do with the distribution of assets. He could sue her, for pain, suffering, and denying him the ability to enjoy his children(at least in the US he could). But it is likely that by the time that lawsuit hit the courts the state would have taken their share and there is no way in hell he's getting it back from them.
