Bruce McClintock SC, acting on behalf of the station, said the Australian Communications and Media Authority was acting as "policeman, prosecutor, judge, jury, prison warden and parole officer" when it delivered a preliminary finding in June. In its report, ACMA found 2Day FM had breached regulations by recording and broadcasting the now-notorious prank call that preceded the suicide of British nurse Jacintha Saldanha. Mr McClintock said ACMA was acting outside its powers and that its findings could unfairly impact any future criminal proceedings. "The courts are the place and the only place where determinations of criminal guilt can be made," Mr McClintock said on Thursday. “The [prank call] incident received widespread notoriety ... nothing would be more prejudicial than the finding by the ACMA. "The ACMA must wait until my client is dealt with – if it ever is dealt with – in the court system." 2Day FM wants the watchdog to be permanently restrained from finding it committed a criminal offence or breached a broadcasting licence condition. The station has a history of causing controversy so action was bound to be take sooner or later.
Considering this is the station that has bloody Sandilands on it, I'm not surprised they're acting like cowards.

of course the Kyle hate has already permeated the thread no laws were broken, it was a prank call that resulted in an already unstable nurse killing herself. this was just the straw that broke the camel's back. prank calls happen all the time, news flash!!! no one DARES blame the incompetence of the hospital, god forbid, just blame the company that has a record of context-ignoring situations that got them into trouble
The AMCA has to always look into cases like this because of pressure from the families and the UK most likely

And least we forget the shear amount of editorial policy that was seemingly ignored for the sake of a dumb prank.
