Samsung welcomes today's ruling denying Apple's request for a preliminary injunction. This ruling confirms our long-held view that Apple's arguments lack merit. In particular, the court has recognized that Samsung has raised substantial questions about the validity of certain Apple design patents. We are confident that we can demonstrate the distinctiveness of Samsung's mobile devices when the case goes to trial next year. We will continue to assert our intellectual property rights and defend against Apple's claims to ensure our continued ability to provide innovative mobile products to consumers.

In a ruling released late on Friday, U.S. District Judge Lucy Koh in San Jose, California denied Apple's request for a preliminary injunction against Samsung.

"It is not clear that an injunction on Samsung's accused devices would prevent Apple from being irreparably harmed,".
This can be only a good thing. Now, we just need for the lawsuits to stop in the EU and the rest of the world. The case is still awaiting hearing, but this is excellent news.
About goddamn time. No company should be able to abuse the patent system like that.

Finally, somebody puts the brakes on Apple's attempts to sue their way into a smartphone monopoly.
It's quite funny how the country that a lot of us make fun of for having a broken patent system is the one that puts their foot down and says that they're not going to deal with the ridiculous patent nonsense. I'm very glad the courts are taking a good look at this instead of just granting Apple an injunction right off the bat.
Some other countries told apple to fuck off about the tablet shit too.
True but some countries like Germany and Australia just slapped down a ban after nothing more than Apple presenting patents that may or may not be valid after investigation.

An patent a day keeps the competition away.
