The Supreme Court ruled Wednesday that the First Amendment protects fundamentalist church members who mount attention-getting, anti-gay protests outside military funerals. The court voted 8-1 in favor of the Westboro Baptist Church of Topeka, Kan. The decision upheld an appeals court ruling that threw out a $5 million judgment to the father of a dead Marine who sued church members after they picketed his son's funeral. Chief Justice John Roberts wrote the opinion for the court. Justice Samuel Alito dissented. "What Westboro said, in the whole context of how and where it chose to say it, is entitled to 'special protection' under the First Amendment," Roberts wrote, "and that protection cannot be overcome by a jury finding that the picketing was outrageous." Matthew Snyder died in Iraq in 2006 and his body was returned to the United States for burial. Members of the Westboro Baptist Church, who have picketed military funerals for several years, decided to protest outside the Westminster, Md., church where Snyder's funeral was to be held... http://www.facepunch.com/threads/1065473-Supreme-Court-rules-for-Westboro-Baptist-Church-over-military-funeral-protests Also "can't the Supreme Court just look away from the amendments for one minute and put these monsters down? ", you're a shitty american.
I'm genuinely amazed that nobody has violently retaliated against WBC
You set aside an amendment and what you are looking at is a means for corruption of power and government. No thanks, I'll keep my rights, no matter who it defends.
The problem with America consists of two factors: 1-People have no idea what their rights are 2-People ABUSE THEIR RIGHTS
can't the Supreme Court just look away from the amendments for one minute and put these monsters down?
uh, no
even free speech is limited in the US, ie. it's illegal to yell EVERYBODY GET ON THE FUCKING GROUND while in an airplane
Charge them with hate speech. Problem solved.
even free speech is limited in the US, sort of like how it's illegal to yell EVERYBODY GET ON THE FUCKING GROUND while in an airplane
Speech is only limited when it can cause a panic or deliberately incite someone to violence. WBC does neither.
The fire in a theatre argument doesn't really attach to free speech. It's speech, but the act is harmful to others and dangerous. If there is a clear danger, then it's a little different then hate speech.
yeah this thing, "clear and present danger" I believe is the term
The fire in a theatre argument doesn't really attach to free speech. It's speech, but the act is harmful to others and dangerous. If there is a clear danger, then it's a little different then hate speech. I'm sick of people using that as an excuse to further 'limiting free speech' [editline]2nd March 2011[/editline]
Charge them with hate speech. Problem solved.
Hate speech isn't a crime
Speech is only limited when it can cause a panic or deliberately incite someone to violence. WBC does neither.
looks like we'll have to expand those exceptions then.
I'm not really sure what to say...I mean, can't the Supreme Court just look away from the amendments for one minute and put these monsters down?
No. Never. No
looks like we'll have to expand those exceptions then.
Or we can not, you know. That's definitely the better route.
Or we can not, you know. That's definitely the better route.
my idea is better because it's not yours
my idea is better because it's not yours
My idea is better because it's not fascistic censorship :colbert:
Ah well, 'Twas a good fight against the bastards, but they still won in the end. At least someone's rights are still protected I suppose...
My idea wasn't very good because I didn't think it through As for the free speech thing, one of my high school teachers always said, "You can say whatever it is you want, but with consequence." Or something like that...
My idea is better because it's not fascistic censorship :colbert:
I'm only censoring stupidity.
I'm only censoring stupidity.
I consider you stupid, thus you should be censored. See how this works? (hint: poorly)
I consider you stupid, thus you should be censored. See how this works? (hint: poorly)
I'm sorry but I'm sane, can't help it if you can only see idiocy as genius
I'm sorry but I'm sane, can't help it if you can only see idiocy as genius
I'm going to need to see medical documentation of your supposed sanity.
Good. I disagree with Westboro and their protesting of funerals is just asinine and horrid, but they have every right to do it.
