The decision to not go to the Supreme Court comes as the White House is examining several options to save President Donald Trump's controversial executive order on immigration.
"We will win that battle. The unfortunate part is that it takes time statutorily, but we will win that battle. We also have a lot of other options, including just filing a brand new order," Trump told reporters onboard Air Force One Friday evening.
Asked if his plan might be to issue a new executive order, POTUS said: "It very well could be. We need speed for reasons of security, so it very well could be."
In the aftermath of a federal appellate court's decisive blow to Trump's move to ban citizens of seven majority-Muslim countries from entering the United States, the White House is working on "possible tweaks" to the executive order, according to a source in close contact with the White House on national security issues.
Should it write a new order, it would be more narrowly tailored than the one issued two weeks ago, the source said, such as explicitly stating that it does not apply to legal permanent residents.
Questions on next steps have swirled since Thursday evening when the 9th Circuit Court of Appeals refused to lift of temporary restraining order on Trump's executive order barring foreign nationals from Iran, Sudan, Libya, Somalia, Syria, Iraq and Yemen from entering the country for 90 days, all refugees for 120 days, and all refugees from Syria indefinitely.[/quote]

Funny thing is, the court rejected Trump's cause specifically (or at least partially) because he referred to it as a muslim ban in his campaign. Wording it slightly differently won't change that.

They're not going to appeal because it's a fucking loser of a case. They know there is no point. They will keep issuing orders for those brief moments when they can ban Muslims before they get overturned, and the fact that they get shot down only helps their goal of discrediting the judiciary by making them seem un-American, which drives the easily-conned populace into the arms of the republicans.
They're just going to wait till the SC is stacked.
I honestly starting to think that this whole Muslim ban was not meant as an actual serious thing, but was an action meant to disguise some of the other shit the Trump Administration has done recently, such as the absolutely terrifying appointment of Steve Bannon. The Trump Administration is playing with fire here, and one of the best ways to stop a normal fire is to set off a bigger one, controlled one, right next to it, it snuffles the flames.

No, the precedent is already set. He talked about specifically banning MUSLIMS, and any veiled attempt to do so will be interpreted as a violation of the establishment clause.

This is exactly what I expect them to do, find a commonality between all the countries they want to ban and frame it along those lines, which mean a couple of poor African countries probably get hit in the process as long as he gets what he wants.
On a side note, he better not touch Lichtenstein - their last war was in 1866, they left with 80 soldiers and they came back with 81, because they made a friend. It's kind of adorable.
