Regardless her position and mission there which are eyebrow rising on their own, how the hell is anybody responsible for you tripping on their curb?
I can understand when somebody sues after falling into unsecured manhole, but how the hell do you make your curb trip-safe?

You don't. This is most likely just compensation for the "embarrassment" she suffered from tripping, which is fucking stupid.

That's the curb? Wow, death trap waiting to happen.
Sounds like she took a bit of a fall:
injured her left leg and right wrist and went to the West Suffolk Hospital
And I get the impression that she had to take time off duty, so she's not just suing for "embarrassment"

"This, this is the fucker right here... heartless woman tripping bastard"
evermind apparently im wrong???
"As she proceeded around to the jet wash area, located on the right hand side of the filling station, she moved toward a gap in the fencing in order to access the rear of the premises.
"Unknown to our client, there was a section of high kerbing.
"There was very little to draw this raised section to our client's notice an as our client proceeded towards the gap, she was unaware of this step up.
"As such she was caused to trip and fall, thereby sustaining personal injury."
Funny how such a trivial incident can be made to sound serious when you put it in fancy words
I'm going to the kitchen to get a snack
"The act of ingesting nourishment to maintain the synthesis and replication of cells in the human body is necessary to pursue on a daily basis if the continuation of life is desired.
Therefore our client, being the bipedal organism that he is, decided to engage in locomotion by putting one leg in front of the other, while maintaining balance, toward the cooking facilities in his living quarters. In there he knew that the resources for completing the aforementioned task were available.."

Gee at least it wasn't a public injury.

I'm pretty sure most people have tripped over before and didn't think to sue, according to the Daily Mail she's suing for £50,000 with is around 2 years wages

It's called "looking at where you go"
This reeks of those cases where people sue for some stupid mistake they make just for a fat load of cash.

She's suing a business, I'm not a legal expert but I'm sure businesses have to have insurance and meet safety guidelines concerning lighting, I say this because she reckons there was:
"inadequate lighting"
+ To my understanding you always sue for more than you actually think you'll get, so she probably wouldn't get £50,000 if she won
EDIT:
Just read another source, owner thinks there was plenty of lighting, so I don't know, end of the day if there courts think there's a case here they'll take it on and decide the verdict

If the world was made of people who sue other people for stuff like this, everyone would be either a poor person or an asshole trying to cash in.
brb finding a poorly lit curb at some petrol station and tripping over it. In public, no less!
As this is a business, there should be a site risk assessment in place. All the garage needs to do is show they have adequate lighting in place and that this is cited on the risk assessment (which it should be) and the woman won't have a case.
There should have been lights.
British police can be arseholes. My friend was arrested when he wolf whistled at a woman who turned out to be the girlfriend of a policeman. They decided to press rape charges against him.
He was also verbally abused in his cell and refused a phone call.
If you'd have a communistic system there, you wouldn't have money-hungry people suing everyone for everything. You capitalists need to open your eyes and see that this system of yours will be your death.
Take arms already damnit and overthrow your corrupt government, the power belongst to the proletariat.
I suppose if the curb wasn't lit I can see where she's coming from, but really the whole claim is wank, she's just a money grubbing bitch.

This is also the curb into the jet wash bay, so not something you should be walking through anyway

Although the gap in the gate does look like an entrance so I'll give her that
My dad is going to be speaking on this issue (being a personal injury solicitor) on the radio tomorrow :v: Apparently someone wants the law changed so policemen can't sue for anything like this.
I don't get this. She got hurt while on the job - responding to a break-in call. If she got shot in the leg during a response to a robbery, would she sue the guy who shot her? The only difference is a factor of "embarrassment" which isn't worth anything. Her job should be covering her while she recovers from her injury that she sustained while working. Is that not common practice?
If I were the judge the case would go like this.
"...Right, court is now in session. We will hear the case of Dumbass Cop VS crime victim...and I rule in favor of the defendant! Case closed. There is no reason to sue over tripping over a curb, so get out of my courtroom before I make you pay court costs, bitch."
She's just trying to force him into a quick settlement. It's a common tactic. Sure, he can refuse to pay and go to court and he will win. But that's going to cost him, perhaps it's cheaper to just settle this out of court, that's what she's hoping he'll think.

It's funny but there are people who actually do that shit for a living, my cousin actually knows a guy who like throws himself down stairs and shit in public, hopefully breaking bones, because if you find a set of stairs where you can't put your whole foot down on the step then it's classed as unsafe and you'll get a substantial payout.
On the other hand, if you throw yourself down a set of stairs you will look like a complete fuckstick.
How do you even sprain your wrist and hurt your leg from tripping over a curb? Is she an old lady? They tend to break a leg just from falling in the shower and because they are old...
And how do you sue someone for that?! It's like sueing the water company because a car sprayed you with water from passing by fast through a puddle of water made by a burst pipe.

This is actually a legitimate type of lawsuit, liability over hazards on private property.
For instance, let's say you have a brick walkway in front of your home, from the sidewalk to your front door. Your mailbox is at your front door. If one of those bricks on your walkway is loose, and your mailcarrier steps on it and breaks an ankle, you'd be liable for that. Your mailcarrier can claim that it's a hazard, it's on the path your mailcarrier must walk on to deliver your mail, and you didn't fix it.
This policewoman is trying to claim the same sort of thing, that there was a hazard, due in part to insufficient lighting. Whether she has a case or not is another question.
When people see an opportunity for free money they take it, they just don't see the cost to their reputation.
My postman slips over on my drive all the time, it's only a matter of time until he sues me
