Del Rosso said Peurifoy prompted officers to deliver a third stun because he remained on his feet and appeared to be aggressive after the first two strikes.
Once Peurifoy hit the ground and was handcuffed, police booked him on charges of resisting arrest and battery on a law enforcement officer. A concealed weapon was found that he holds a permit to carry.[/quote]

I saw nothing wrong with this, until I saw the charges. How can they charge him for resisting arrest when no crime was committed to warrant his arrest, let alone charge him for battery when he never attacked them?
Both groups in there are being stupid, the guy fucking jaywalked something against the law, and the man being apprehended should have just gone along and then brought it up at a police station where it would have been handled in a far better manner. The police could have been far more professional and non-confrontational when dealing with the individual which would greatly eased the situation.
Basically cop gets him on something lame, ends up being a ticket or warning though.
Instead of being level headed the guy fails to provide basic identification, which is a crime.
He says he isn't resisting, but pulling away and constantly turning towards the officers who are attempting to detain him. the suspect or whatever decided to instigate the issue, and the stupid bitch behind the camera isn't helping issue. It is a huge clusterfucker, the female and the other guy where being stupid.
The streets isn't the court room, take the ticket and go to court and fight it. They gave that guy a ton of chances to chill out, they had a lot of restraint in my eyes.
This is how it could have went
Cop pulls this guy to the side, guy gives him ID.
Cop possibly gives him a ticket, but more of a lecture
Both go on their way
Guy fights ticket in court and is fine.
For the posts above, failure to identify is a crime. That is what he got arrested for.

The crime was jaywalking. Then when he refused to ID himself prompted the arrest.

Unless the police have a probable cause you do not have to show the police your ID or give them your name. However the guy in the video shot himself in the foot.

As a rule of thumb, you only have to show your ID to police if they have justification to detain you. I'm not sure if jaywalking is enough to detain someone.
If you aren't being detained, you don't have to show the officer anything.
Unfortunately, a lot of cops have it in their heads that showing your identity is compulsory, when the police need probable cause to make such a demand and to arrest someone for refusing to cooperate. Even in states with Stop and Identify laws, there needs to be some basis of criminal activity for the cops to demand identification. Florida, for instance, made "prowling" a loosely defined misdemeanor ("acting in such a way which a lawful citizen would not act"), which serves only to give justification for detaining people who look at the cops the wrong way.

Assault and Battery is when it becomes physical.
Just plain assault would be things such as intimidation, physical threat, etc.

I do not see an issue why people do not understand this.
Even if it was for jaywalking and is minor - he still committed an offense and was required to ID himself.
Most that would have happened had he IDed himself if they would have ran him for wants and warrants and cut him loose after a verbal warning. Rarely will there be a ticket given for jaywalking.
The officers had plenty of probable cause to ID this guy. He broke the law. Even if it was indeed minor.
