Republicans push bill to split up ‘nutty 9th Circuit’

Conservatives have mocked the 9th Circuit for years, often calling it the “Nutty 9th” or the “9th Circus,” in part because so many of its rulings have been overturned by the U.S. Supreme Court.
Under Flake’s bill, the new circuit would cover Nevada, Washington, Idaho, Montana, Arizona and Alaska, leaving the 9th with three Pacific states as well as the Northern Mariana Islands and Guam. A separate House version introduced by Rep. Andy Biggs and four other Arizona Republicans would leave Washington state in the 9th Circuit.
Congress created the court in 1891. At the time, the area was sparsely inhabited – only four percent of the U.S. population lived in the area compared to today’s 20 percent.[/QUOTE]

This seems like a fair assessment to split it up.
Calling it "the nutty 9th" is dumb, but there seems to be legitimate, bipartisan cause to do this.
Predictable they pan the court for being too liberal because they're against their idea of American "values."

I think taking 15 months to hand down a decision is even more of a reason. If they are that congested, they should split it up.
If you put aside the partisan bullshit, the Ninth Circuit really is a huge jurisdiction. The eastern half of the nation is broken into several decently-sized jurisdictions, while the Ninth Circuit consumes the entire West Coast and two-fifths of the nation. Covering that many people and that much land truly isn't an efficient distribution of burden for the court system.

if you read into it, it's not a bad idea
it's a huge circuit court that is mind-bogglingly slow and comprises over 60 million people whose jurisdiction it falls under.

I'm not a Trump voter but if you want a strong counter argument to ~oligarchy~ then Trump's it; all the big scary monied interests backed other horses in the race (remember Jebbie Bush's "war chest?") but it was the one rural voters wanted that swung the electoral college not the one the dollars wanted[/QUOTE]

I was wondering about that too. When was the last time the 9th circuit was complained about by republicans?
9th Circuit has always been a massive pain in the ass, its one of the circuits which constantly pushes gun control, sanctuary cities, and among other things. Not to mention it' comprised of both Arizona and California as one entity, even though historically they are polar opposites politically.
I can already see a lot of benefits outside of the obvious, "good timing, shitheads" issue.

split them up so only liberal dominated courts cover liberal states, make new courts for a republican congress to stock. any new court district made today would be a cudgel to force right wing ideals onto everybody since i doubt congress or the president would let any single left leaning person on the bench

Only reason the 9th Circuit is the one that looked over Trump's executive order is because a state in its region filed suit against it first. Had Vermont or Texas done so first instead, this whole thing probably wouldn't even be news.

there isnt a conspiracy there, the guy describes the thing as being a nutty liberal circuit which sort of sets off alarms these days since it seems the republicans are on a liberal witch hunt

To be fair even legitimate reasons can be abused. People overreacted a bit but there's no reason not to scrutinize their proposal.

The 9th has a fucking stupid amount of cases overturned by the supreme court. Even if you divide the cases into guns + others, both piles are enormous. And it's not like the 9th has revisited an issue later and agreed with the supreme court. No, they've stubbornly held to rulings with altered phrasings only to get slapped down again. The 9th is fundamentally not all that different than courts in texas, alabama, etc, upholding blatantly unconstitutional laws on abortion. It's just insane on the other side of the fence. Or perhaps calling it a mirror is more appropriate given the similarities.
