TORONTO (Reuters) - A Canadian truck driver has been fined for smoking in his vehicle because it is considered his workplace, a police spokeswoman said on Friday. A police officer saw the 48-year-old trucker driving on a highway in southwestern Ontario with a cigarette in his mouth on Wednesday, and gave him a C$305 ($290) ticket. The Smoke-Free Ontario Act, adopted in 2006, prohibits smoking in an enclosed workplace or enclosed public area, and that extends to work vehicles, said Constable Shawna Coulter of the Ontario Provincial Police in Essex County. "We enforce the legislation and this truck driver was in violation of that," she said.
Source Okay, so it is regulation, and the truck is considered the workplace... But come on! It's HIS truck, and he's not hurting anyone other than himself.
It gives those chips the extra smokey flavor
That's ridiculous. A workplace is something like a public office building/facility.
What trucker doesn't smoke?
What trucker doesn't smoke?
a canadian trucker, apparently
That's ridiculous. A workplace is something like a public office building/facility.
workplace = somewhere where you work.
workplace = somewhere where you work.
But this is his truck. He's the only one who's ever going to be in it.
But this is his truck. He's the only one who's ever going to be in it.
It's where he works.
Don't you actually own the truck you drive? If so, this is incredibly stupid.
It's where he works.
and ONLY him
Don't you actually own the truck you drive? If so, this is incredibly stupid.
Not entirely. If you work as a contractor then you would own your vehicle. But most truckers work for actually companies and don't own the trucks they are driving.
What a dick cop.
I wouldn't call it an enclosed space if he had the window down.
and ONLY him
But the company owns the truck, so they can mandate if he can or can't smoke in it.
It's where he works.
If I ran a business from my home, I think I should be able to smoke in my own home.
"Hey man, I'm so glad our home-based antique business is working out; I'll go get the victory ciga-" THIS IS THE POLICE, GET ON THE FUCKING FLOOR, DIRTBAG.
I can totally understand it for company trucks. They are driven by multiple people, and how is it fair to force a non-smoker to sit in a truck for hours at a time that's completely saturated by nicotine and tar because the asshole before him smoked in it? If you don't like it, become an owner-operator. Otherwise, follow the company rules and deal with it.
$305 deal w/ it
But the company owns the truck, so they can mandate if he can or can't smoke in it.
You do know companies can hire people with their own trucks right? Still, if it IS the companies, then tough shit I guess.
If I ran a business from my home, I think I should be able to smoke in my own home.
If it's not breaking regulations, sure.
Personally I'd be curious to know what he was hauling. There are a lot of federal regulations for truck drivers on what kind of material loads they cannot smoke around.
It's where he works.
People sometimes work at home. Does it make it illegal for them to smoke there?
People sometimes work at home. Does it make it illegal for them to smoke there?
Apparently it does.
If I ran a business from my home, I think I should be able to smoke in my own home.
Yes - unless you'd have a publicly accessible office. Then it still counts as an enclosed public place.
I guess my question would be what sort of cargo was he carrying?
But the company owns the truck, so they can mandate if he can or can't smoke in it.
It's probably his truck. Most larger companies will have a fleet, but some people who run their own business or are on contract use their own truck. [editline]11:31AM[/editline] So would this law apply if I was on the clock and driving across town in my car to pick up some stuff from the store on the east side of town?
I guess my question would be what sort of cargo was he carrying?
He was delivering cigarettes, boxes of them.
He was delivering cigarettes, boxes of them.
:irony:

Who smokes with the windows up? Ew.
