Secret Service raid home of Apple Store webcam 'artist'

[release]The US Secret Service has raided the home of an artist who collected images from webcams in a New York Apple store.
Kyle McDonald is said to have installed software that photographed people looking at laptops then uploaded the pictures to a website.
Mr McDonald said he had obtained permission from a security guard to take photos inside the store.
Apple declined to comment. However, the Secret Service confirmed that its electronic crime division was involved.
A spokesperson told the BBC that the investigation was taking place under US Code Title 18 /1030 which relates to "Fraud and related activity in connection with computers."
Offences covered by the legislation carry a maximum penalty of 20 years in prison.
Writing on Twitter, Mr McDonald said: "@secretservice just stopped by to investigate [web address removed] and took my laptop. Please assume they're reading any e-mails you send me."
No arrests had been made in the case as of 8 July.

Kyle McDonald's images were uploaded to a page on the blogging site Tumblr.
In the description of People Staring at Computers, the project is described as: "A photographic intervention. Custom app installed around NYC, taking a picture every minute and uploading it if a face is found in the image.
"Exhibited on site with a remotely triggered app that displayed the photos full screen on every available computer."
The site features a video and series of photographs, apparently showing shoppers trying-out computers.
Comments on the individuals by visitors to the site are also attached to the images.
Mr McDonald, writing on Twitter, said that he had been advised not to comment on the case by the online freedom group the Electronic Frontier Foundation.[/release]
If they didn't know they were having their picture taken, then really he deserves all he gets.

The article is not clear if the guard/store was aware of fully what he was doing, or if he had specific permission to install software. I don't think you should assume. Nor use the opportunity to take a shot at macs. While shitty computers, possibly undeserved in this case.

Well, which scenario would be more likely
1) The guy walked into a Manhattan Apple store and says to the security guard "Hey, can I download and install an app on every Mac in the building that takes photos of everyone who uses them?"
- or -
2) The guy walked into a Manhattan Apple store and says to the security guard "Hey, can I take pictures in the store for an art project?"
(keep in mind we're talking about privately contracted security guards here- they probably don't work for Apple)

This has happened before..in fact it was a school district near PA where the School administration was taking pictures of their students at home without their knowledge.

I'm not taking a shot a Mac, I'm trying to point out that every time someone gets raided we instantly cry foul on the government. If someone wants to press charges, then charges are pressed. It is up to the individual, in this case Apple Inc, to say we want to press charges. If that is said, then the government starts spinning its gears likes its supposed to.
And also, after all the massive website attacks on corporations, Apple was hit, then it isn't surprising they would over react in the first place anyway.

I got dumb for using the word 'hacking' instead of using the PC term for it because everyone wants to make sure that no one is given the aura of skills with computers because we're egotistical like that here.
