The Citrus County Sheriff’s office told the Tampa Bay Tribune and the Associated Press that Cody Wygant, 24, has been charged with third-degree murder and willful child neglect.
According to the Tribune:
Citrus County Fire Rescue responded to Wygant’s home after receiving an emergency call at 8:21 a.m. Thursday that the child, Daymeon Wygant, wasn’t breathing.
According to the sheriff’s office, he confessed that he suffocated his son to be able to play video games. Wygant told investigators that he was frustrated that Daymeon was crying uncontrollably and preventing him from playing Xbox games, the sheriff’s office said.
At about 1 a.m. Thursday, Wygant placed his hand over Daymeon’s mouth and nose for three to four minutes. He told investigators that his son became lethargic and appeared exhausted. He placed him in the playpen covering him with multiple layers of bedding, the sheriff’s office said. Daymeon’s entire body was covered, including his head. The bedding was tucked under the boy in a manner that prevented the boy from receiving fresh air, the sheriff’s office said.

As far as I'm aware, I think the average prisoner in an American jail doesn't take too kindly to child killers, so I'm pretty sure what this guy's fate is going to be within the next year. And even if he dodges that kind of bullet, I hope his life in prison is nothing more than a misery.

Well he will suffer whether you like it or not, American prison is a cesspool. We just take criminals, throw them behind some walls, and they're the guard's responsibility until they get out. And the guards don't give a shit anymore, they do just enough to keep themselves safe and their pay coming in.

it's obvious he didn't intend to kill his kid. he wanted to calm him down and then foolishly covered him with too many blankets (probably an effort to muffle the noise) which ended up killing him
third degree murder is murder through indifference / negligence and is pretty much reserved for parent-child relationships and drunk driving.
